TAMMY peeks in hopes of seeing the fading structure of the truck. As she turns her attention back to the intruder she sees that the fat end of the bat is on its way to being slammed into her stomach area. Buckling to her knees in pain as tears flow freely down her cheeks. She cries out.
TAMMY
I beg you to stop... Please, don't hurt me
Blood begins oozing from her mouth as she begins to choke and spit out. She lifts her head upwardly. As she trembles, she stutters out amidst tears of pain streaming down her face.
TAMMY
It hurts...I hurt so much
The bat is swung downwards towards her upper torso. The contact is loud, a thump. Moaning she sprawls out on the ground.

He is a member of the Maricopa County sheriff posse dressed in a sheriff uniform and a cowboy hat.
POSSE MEMBER ATKINS
FREEZE! DON'T MOVE!
The posse member raises a handgun. Instantly gloved hands rise into the air. The gun is elevated in the direction of the intruder. Suddenly a flash of light burst brightly into the desert night. BANG! The sound of the shot echoes in the dry desert air. The bullet impact on the road set off sparks feet from the intruder. A rattlesnake is seen scampering away across the road only yards away.

POSSE MEMBER
Look partner, you can't be parked there none. I'll give you a break this time cause in the morning I fly out of the country for a month
The posse member makes his way back to his vehicle. At the door he puts his weapon back into the vehicle and turns to the intruder
POSSE MEMBER
I'm not suppose to carry any gun but If you don't mind any I see no need to make a report. Let's just call this an oral warning.
The intruder extends both hands out communicating whatever.
The Posse member tips his hat, returns to his vehicle and climbs into his vehicle. He drives around the angled SUV down the road.
24 INT - LIVING ROOM (GEORGE) - MORNING (day 2) 24
JOHN GEORGE and his wife, NANCY, dressed in casual attire are sitting in their moderate living room. Members of the Tempe police walk in and out of the room. JOHN talks with NANCY who is sitting against the corner portion of the sofa sobbing.
24
JOHN GEORGE
I tucked her in around eight-o-clock She had a camping trip this morning. Everything seemed fine at that time. She was... IS our baby We don't have any other children.
NANCY cries out loud holding TAMMY'S eyeglasses. At this time,
Tempe Police detective, DAVE DUGAN, white male, late 30's, well-dressed, physically fit, a seventeen year veteran of the force, walks in.
He is accompanied by his partner, detective MONYETTE SHELL, black female, late 20's, slim, dressed in the latest fashion, a not to recent college graduate, sits on a sofa. DUGAN puts his notes on a table.
DET. DUGAN
We're searching the immediate area. She might have just taken off to one of those rave gatherings in the desert.
NANCY GEORGE sits up and looks sincerely at the detectives.
NANCY GEORGE
That would not be like her...at all She was looking forward to her camp.
DET SHELL
Sometimes the best of kids surprise us. They get scared to come back if they know or even think you know they were out without permission
DET DUGAN
Sir, we could not find any forced entry. NANCY Sometimes we might forget to lock a door. As you can see we live out in the desert and we have a trained pit bull out back We feel ...had felt comfortable with him.
JOHN GEORGE
We just ignored that dog when he was barking like a lunatic and I dozed off.
25
A uniformed officer enters the room approaching DUGAN and whispers into his ear. DUGAN turns to the GEORGES'
DUGAN
Excuse me, I need to step outside to handle some business.
SHELL moves to sit on a chair in an attempt to distract the family.
25 EXT - PORCH (GEORGE) - MORNING 25
DUGAN and officer enter porch and walk to a spot next to patio furniture.
DET DUGAN
Well what do you have?
OFFICER DENNIS
Sir, a body of a young female has been found in the desert not too far from here
DET. DUGAN turns and walks ten feet away before he stops and takes a deep breath. He turns towards the officer.
DET. DUGAN
Did her face match the photo that was faxed out to all units?
OFFICER DENNIS
It could not be determined. Not yet!
DUGAN moves to the officer and speaks in an agitated tone
DUGAN
What do you mean... not yet?
OFFICER DENNIS
Sheriff's office is the responding agency.
DUGAN getting more frustrated slams his fist into his hand
DET DUGAN
Any decomposition? Is it to similar to distinguish without dental records? Has forsensic odontology been contacted?
26
OFFICER DUGAN
Just a lot of dust, matted blood. The coroner has the body and is cleaning it up as we speak.
DET DUGAN
How much rigor mortis has set in? If we know that maybe it's not our girl.
OFFICER DENNIS
Not determined but there was a Saguaro tree near the body with an apparent fresh dent on it.
DET. DUGAN
Was there anything else?
OFFICER DENNIS
Oh yeah, there was a baseball cap
DET. DUGAN
Is it from the suspect?
OFFICER DENNIS
The victim was wearing jogging type clothing, the kind people often sleep in too. The cap itself is black in color, a Diamondback's cap.
24A INT - LIVING ROOM (GEORGE) - MORNING 24A
DUGAN reenters the living room nonchalantly. He stands near SHELL and picks up his notes.
DET DUGAN
Folks, you will have to excuse us. We have an emergency to tend to.
SHELL rises from her seat and straightens her clothing. JOHN GEORGE escorts the detectives. DUGAN stops and turns to JOHN
DET DUGAN
Sir, I do have one question, did she normally wear headgear?
JOHN GEORGE burst out with an incredulous look.
27
JOHN GEORGE
NO WAY! She loved her hair. She didn't want anything to cover it
DUGAN lets out a slight grin so as not to let on
DET SHELL
Just that a lot of kids, even girls, are wearing caps
JOHN GEORGE
She would never wear a hat. In fact, I often get different types of baseball caps, Diamondbacks, but she refuses to wear them. She just collects them.
DUGAN and SHELL walk away as SHELL whispers
SHELL
I'll make sure someone takes him to the morgue for possible identification
18D EXT - DESERT LANDSCAPE - MID-MORNING (day 3) 18D Maricopa County sheriff, DON AHHOE, late 50ish, a bit over weight, wearing a new cowboy hat, conducts a news conference out in the treacherous desert near where the body was found.
DON AHHOE
As many of you know, I do not tolerate crime. My jails are full of bad people. But there is always room for one more...
LOCAL REPORTER
Is that due to the recent rash of jail escapes?
DON AHHOE tries to mask his apparent dismay, his anger growing.
DON AHHOE
I'm talking of the scum responsible for the kidnapping and murder of this young person
LOCAL REPORTER
What is your office doing to solve this case?
28
DON AHHOE
My investigators are covering this case as tight as molasses on an ant hole. But we can always use the assistance of the community to bring justice to the fore front.
NATIONAL REPORTER
Sheriff A HOE... A flustered look comes upon the Sheriff as his deputies and local media try to hide their amusement. An aide runs to the microphone
AIDE
Sir, that would be pronounced AHHOE
NATIONAL REPORTER
Sorry. Sheriff, what leads do you have? What is your office doing in this matter? The sheriff lifts his cowboy hat to wipe beats of sweat.
DON AHHOE
It appears the scumbag parked on the roadside. My deputies took tire impressions using denta stone instead of plastic cast. The impression is better and more durable. They will compare the tire track with the tread reference guide..
NATIONAL REPORTER
What is the significance of the baseball cap?
DON AHHOE
I intend to have my posse on horseback, helicopters, four-wheelers, and on foot combing these parts to find that out. I have to go now.
DON AHHOE walks away from the reporters heading straight for his aide. The aide looks frightened by the approaching sheriff.
DON AHHOE
I think that bozo mispronounced my name intentionally to make me look bad.
AIDE replies in hopes of cheering her boss
29
AIDE
I...I...I am sure he wouldn't need to do that ...not intentionally
Sheriff Don pauses and poses menacingly at his aide. The aide is intimidated and tries to atone for her misstatement
AIDE
What I mean Sir, is that...
AHHOE raises a hand to motion for her to stop talking
DON AHHOE
How did they find out about the cap! I want a full investigation to find the leak. Find out whom in the department is talking. and who put the bozo up to mispronounce my name, to attack my integrity.
The aide shrugs her shoulders as she nervously takes notes.
AIDE
Do you want me to pull men off this matter?
DON AHHOE
Not now, they already think I'm paranoid.
Sheriff Don smiles at the media. He turns to his aide whispering
DON AHHOE
Send more posse and horses it's good press. Make sure my name is prominently displayed
26 EXT - TEMPE MUNCIPAL BUILDING - NOON (day 3) 26 Detectives DUGAN and SHELL lunch outside the City of Tempe upside down triangle municipal building. The building appears to be precariously perched on a triangular point. They sit in the shade enjoying the breeze passing through the passageway
DUGAN
It's been two days since the disappearance and the clown puts on a circus at the crime scene.
30
SHELL
We don't let the media know every detail for obvious reasons, even when we know identity. Here the body was found just outside city limits, the County Sheriff is involved.
DUGAN
He's hardly a marvel of mental agility. Most likely he has destroyed any transient evidence there was.
DUGAN takes a bite of his lunch
SHELL
You're right since by nature any physical transient evidence is temporary thus it can be easily changed or lost. In a desert, the temperature alone is going to adversely affect the cadaver.
DUGAN
What does he do? He allows the media to trample the crime scene. The evidence must be comprised. I'm not too optimistic of the responding officers having recorded or even documenting the scene since they're claiming the photos are not very good because of bad lighting or filters. Plus there was no video tape.
SHELL
We need to get out there to see if that was the original scene or if the body was just dumped there. Going to be hard for any reconstruction without good photos or video. From around a corner, SHELL sees a group of school children following a teacher heading to the municipal building. A young female student waves.
SHELL
Isn't that your oldest daughter waving?
DUGAN
Yeah, that's LYNN"S class, volunteered to give them a tour of city hall and department
31
DUGAN looks again at his watch, squirms a little, then waves
SHELL
Oh, You're such a sweet dad
DUGAN
I better catch up before something comes up. This means a lot to her
27 INT - CHILD'S BEDROOM (SHELL) - MORNING (day 4) 27

MONYETTE SHELL
Honey, we're just going to the park
LANCE SHELL
I'm just thinking about the missing girl
MONYETTE stops and looks at her husband.
LANCE
I don't want to know how it feels to worry so much for someone who's your whole life
MONYETTE SHELL
You mean daddy's little girl?
MONYETTE inquires of her husband with a teasing grin.
LANCE SHELL
What can I say?
MONYETTE SHELL
Aren't you late for work or something? LANCE glances at his watch and flinches. He approaches his daughter and gives her a kiss and then his wife.
HUSBAND
I love BOTH of you He stands and leaves the room as MONYETTE smiles at her daughter.

MELISSA
Sir, PLEASE STOP! Did you see anyone by those trees? The sweating jogger is surprised by MELISSA'S assertiveness but runs in place as he wonders what this is about. She points to a section of tree. The jogger follows her finger looking in that direction. His head sideways as if to get a better angle.
30C EXT - PARK TREES - MORNING 30C The trees sway freely. The person with the cap has deftly slipped past their line of vision.
28E EXT - JOGGING PATH - MORNING 28E
Jogger stops his running in place and becomes sincere.
JOGGER
Sorry I don't see anyone by the trees
The JOGGER looks down the path as he diverts his attention towards a scantly clan female jogger. When she passes the arrogant jogger resumes his focus to MELISSA who now glares at his roving eyes.
JOGGER
Hey, you're not trying to pick me up?
MELISSA
Are you kidding! Maybe I'm just getting paranoid with that killer... She stops mid-sentence as anxiety causes her to ring her hands into each.
MELISSA
...You know from the girl in the desert. I think my family knows her family My dad's friends' daughter is missing
35
JOGGER
Yeah, I did hear about that. Hey, you need to be careful.
Male jogger vainly and mechanically flexes his muscles
JOGGER
Sorry, don't want to tighten up You look shaken, want me to jog with you?

32 EXT- STREET /CONDOMINIUM (MELISSA) -MORNING 32
Upon reaching her condominium MELISSA ceases her jogging. She begins to stretch out as her sweat drenches her clothing. Her body glistens. She looks down the street while shaking her legs.
(Rear view) The same person with the white baseball cap, long dark sleeves and dark hair appears strolling down MELISSA'S street. MELISSA continues to stretch oblivious to the person walking in her direction. A neighbor, DEBRA, black, 24, opens her window and sees MELISSA unwinding. DEBRA opens and leans out the window.
DEBRA
Girl! You sure are a fool!
MELISSA is startled at the voice and stops her stretching. She looks up.
DEBRA
Don't you know there is a killer out there? No telling where he is, or who he is. You white girls just don't have no sense.
MELISSA looks at the sky and breathes out. She then gives DEBRA a dirty look before breaking out in a smile.
MELISSA
Don't spoil such a beautiful day
DEBRA extends her arm out with hand open
DEBRA
You might as well talk to the hand.
MELISSA
Girlfriend, I will not only talk to your hand but I WILL tell you it is days like this that makes life living for. What a life!

MELISSA
And how would you know that? I suppose you got the 911
DEBRA
First of all, it's 411.
MELISSA laughs at this error, but DEBRA is on a roll
DEBRA
Second, no black man going nowhere near the desert. The brother is not about to get his ride all dirty from clouds of kicked up dust, some big ass tumbleweed getting on his grill. Oh no, not with those rattlesnakes out there just waiting to bite one of you white folks enjoying nature
(Rear view) Person with white cap leaves the curb a few buildings before MELISSA'S

MELISSA steals a quick glance towards a group milling around the corner. She sees a man conversing with two females. Meanwhile the person in the white cap is stepping onto the sidewalk across the street. Her eyes change directions to across the street. Just then a delivery truck stops.

(Rear view) She is slapped across the face with a gloved hand as she readies to scream. She falls half way onto the bed unconscious. Her entire body is hoisted onto the bed. As she lays limp her hair is stroked. Gloved hands move to touch the contours of her body.
38 INT - CAR (RACHEL'S) - NIGHT (day 4) 38
RACHEL stares out of the windshield in a tunnel vision like manner. Her husband, ROBERT, drives with headphones on. She raises the cell phone she is holding and dials. She looks at the phone listening to the phone ring ...RING...RING...RING...
RACHEL
Why doesn't she answer her phone? What in the world is happening?
ROBERT ignores her rambling on. RACHEL puts the cell phone down on her lap as it continues to ring. RING...RING...RING...
34D INT - BEDROOM (MELISSA) - NIGHT (day 4) 34D RING... RING.... RING...
(Rear view) The ringing of the phone startles the intruder. Jumping up from the bed the intruder stares cautiously around the room. Moving with urgency the intruder strides to the bathroom to shut off the light. A nightlight provides an extremely dim light. The ringing stops.
MELISSA regaining her senses in the substantially darkened room opens her eyes. She remains rigid except for her arms feeling for the intruder. She groggily reaches for and grabs a pillow to cover her body. Although stunned she raises her head slightly as her eyes search the bedroom. Suddenly, the volume of the music is increased. Sitting up she sees a silhouette enter the bedroom. In a somewhat weak voice she hollers out.
MELISSA
Get the hell out of here! What do you want from me?
43
39 INT - CONDOMINIUM HALLWAY (day 4) 39
DEBRA shuts her door. Music can be heard roaring from the area of MELISSA'S condo. Using a key from a chain around her neck she secures her door. She saunters down the hallway.
RADIO
"...All my ex's live in Texas"
DEBRA rolls her eyes. Observing trash on the ground near a trash can she stops walking to gather it. Crouching down she picks it up.
34E INT - BEDROOM (MELISSA) - DARK (day 4) 34E
The intruder proceeds towards the bed until the nightlight provides enough light that part of the intruder's body is visible. Reaching into a pocket a surgical type knife is partially pulled out. Seeing the knife her eyes are wide as she backs up further onto her bed.
39A INT - CONDOMINIUM HALLWAY - LIGHTED (day 4) 39A
DEBRA rising from her crouching position, with the trash, blinks to a neighbor wearing headphones attached to a hand held radio.
DEBRA
Hello RHALID, you know this is what I would like to do to that music.
RHALID cringes as he removes his headphones as the maddening volume continues to bounce off the corridor walls
DEBRA
That is from that country ass girl
RHALID
I can barely hear the Diamondback game. Please make it stop.
DEBRA empties her hands of the trash depositing it into a can
DEBRA
I can't believe I'm friends with her. I got to give that woman some soul! First she got to give me my oregano.
44
34F INT - BEDROOM (MELISSA) -DARK (day 4) 34F
(Rear view) Gloved hands flatten the pillow. The intruder forces the pillow firmly against MELISSA'S face. She struggles vigorously but her efforts begin to fade. Weakened she is on the verge of passing out.
40 INT - OUTSIDE CONDOMINIUM DOOR - LIGHT 40
DEBRA walks up to MELISSA'S door and listens for a presence
RADIO
"That's why I hang my hat in Tennessee"
DEBRA knocks on the door. KNOCK...KNOCK...KNOCK
DEBRA
Are you there or you just got that damn country music so loud just to annoy me?
DEBRA stands at the door with arms folded and lips twisted. She waits.
34G INT - BEDROOM (MELISSA) - NIGHT (day 4) 34G
(Rear view)
The head of the intruder lifts upon hearing the pounding on the door. The pillow is loosened as the intruder gets off of the motionless MELISSSA
40A INT - OUTSIDE CONDOMINIUM DOOR - LIGHT 40A KNOCK...KNOCK...KNOCK
DEBRA reaches for the chain around her neck. Nodding to the beat of the music she clumsily mishandles the chain. The key falls off the chain onto the floor. She picks up the key from the floor and places it into the lock.
36B INT - LIVING ROOM/DOOR (MELISSA) - DARK 36B
(Rear view)
The intruder waits behind the front door. The sound of the key being inserted into the lock peaks interest. Hands are raised and at the ready.
40B INT - OUTSIDE CONDO DOOR - LIGHT (day 4) 40B
As DEBRA is about to turn the key she whispers to herself.
45
DEBRA
Must be a little too much wine tonight cause even that country crap sounds good! Oh yeah, better try the secret knock first in case your kickin it with some lucky stud She knocks out a secret code the girls have to ensure privacy in the event of a possible liaison. Music continues to blur out as she retracts the key
34H INT- BEDROOM (MELISSA) - DARK (day 4) 34H The pillow remains over MELISSA'S face. She is still until her arm slowly brushes the pillow aside. Her head turns to its side. She is able to lift her head off of the bed but an inch or two. Collapsing back onto the bed her arm causes a statute to fall to the floor.
40C INT - OUTSIDE CONDO DOOR - NIGHT (day 4) 40C
DEBRA is turning and about to leave until she hears something fall on the floor in MELISSA'S condo. She reinserts the key into the keyhole. Slowly she turns the key then stops while whispering
DEBRA
All righty then...I forgot you white girls like that rough stuff. You can tell me all about it later Girl, you a freak!
DEBRA pulls out the key and walks back down the hallway. Passing another male whom acknowledges her presence DEBRA glares at him as she verbalizes her thoughts
DEBRA
A brother knows not to touch a sister the wrong way...he be a fool if he did... He's likely to get jacked up!
34I INT - BEDROOM (MELISSA) - NIGHT (day 4) 34I
MELISSA manages to put her head up. She extends her hand towards the floor. She reaches for and grabs the fallen statute on the floor. Lifting up from the floor she straightens herself on the bed. She surveys the room trying to ascertain the whereabouts of the intruder. She fumbles about trying to find the light switch in the dark trying to avoid being noticed.
46
MELISSA
Where are you, Let me see you.
(Rear view)
As MELISSA is about to touch the light switch the intruder catches her hand. Deliberate and nervously she turns her body to face the intruder. She is shaking with immense fear. The intruder picks up a pillowcase and begins to stretch and twist it. The pillowcase is brought up to her throat.
MELISSA
Wait a minute, you're...
(Rear view)
The intruder suddenly applies a vicious stranglehold around her throat. She becomes motionless as she goes limp. Removing one's self from the bed the intruder looks at the breathless body. The pillowcase is unraveled and tossed onto the floor. The white baseball cap is placed onto her head. The intruder walks to a dresser next to the bathroom door. Lipstick is picked up off the dresser and opened. The intruder scribbles onto the wall. When finished the lipstick is put into a pocket. Passing a hat rack, the intruder plucks a purple baseball cap from it.
32A EXT - STREET (MELISSA) - NIGHT (day 4) 32A A person with dark long sleeves hurries down the street to a black Nissan SUV glancing around to see if anyone is watching. The driver's door is opened without the interior light functioning.
35A INT - DETECTIVE CAR - MORNING (day 5) 35A
DUGAN drives as SHELL rides in the vehicle blowing into her coffee.
DET SHELL
I thought this was going to be a good day until we got the call
DET DUGAN
Another homicide to investigate this early in the morning. At least we don't have to worry about the sheriff.
DET SHELL
It's getting to be 24-7 around here.
47
34J INT - BEDROOM (MELISSA) - MORNING (day 5) 34J
Tempe City police have taped off the crime scene. Officers are busy lifting fingerprints, taking photos and examining other items. DUGAN and SHELL walk into the bedroom DUGAN notices the pillowcase with its he wrinkles on the floor. He bends over to get a closer look. An officer approaches SHELL breaking her observation of the inspecting DUGAN.
OFFICER ELLIG
I have some information for you. The CSO wanted you to know that a white baseball cap, diamondbacks, was left on the body but they've collected it for forensics
SHELL
Same team but different color cap. Hopefully, this sorry ass excuse of a human being wore them. Make sure forensics carefully looks for hairs.
DUGAN glares at the officer as he straightens up. He looks back down towards the pillowcase.
DUGAN
Something is wrong with this picture Everything around here is nice, neat and in it's place. This pillowcase is on the floor and is wrinkled too much. Could be what she was strangled with. Have forensics looks for trace evidence.
SHELL looks over to officer ELLIG
SHELL
Any word on hairs from the desert case?
OFFICER ELLIG
I have to get back to you on that although I believe that the sheriff's office is being tight lipped on sharing any findings.
SHELL
I can't understand that office, we are suppose to be working for the same goals.
48
DET DUGAN ignores this topic and waves the officer off. He bends over for a closer inspection of the body. He motions to SHELL for her to join him and to examine an arm. She examines the arm closely.
SHELL
That bruising looks like finger impressions
DUGAN
Looks like the suspect used pressure in either lifting, pushing, or grabbing her in this area. We can't have anyone touch or clean this body until the forensic scientist sprays phenolphthalein on those impressions see if prints can be preserved.
SHELL
Unless like the GEORGE case we find no prints Who ever did this must have worn gloves. If we get prints then I'll make sure we check AFIS for a possible match.
DET DUGAN
Looks like we have the same message
DET. SHELL
STRIKE ONE?
DUGAN points to a message on an opposite wall printed with lipstick as he shakes his head communicating a negative response.
DET DUGAN
Now we have STRIKE TWO!
41 INT - SPARKY'S SPORTS BAR -AFTERNOON (day 5) 41 SPANKY'S bar, hangout for present and former baseball players is not crowed but the bar area is buzzing. Photos of local players in college and professional uniforms hand on walls. Autographed bats and baseballs, trophies, and other memorabilia loom thorough out the establishment.
TOM SUTTON, 22, male, wearing a white Diamondback baseball cap with dark hair protruding beneath it, sits at the bar.
TOM SUTTON
Hey PHIL, how long did you roam in the minors before they let you go?
49
PHIL BOYER, 21, has a purple Diamondback baseball cap over his black hair. He is drinking a beer and lowers it to answer. He turns in his seat and looks over to TOM.
PHIL BOYER
Don't remind me of that garbage. I got screwed by people who don't know their ass from their elbow.
ADAM NOLAND, 22, dark brown hair, is sitting next to PHIL. He is reading baseball weekly with his beer on the bar. ADAM glances up from under a black diamondbacks cap.
ADAM NOLAND
I hear you, they promise all these things to get you to leave school. As soon as your injured or not valuable to them they turn their backs and walk away.
BARTENDER, 58, gray hair, approaches, drying glasses
BARTENDER
Stop whining like women... You all got to go to college for free. You got to travel to different cities.
ADAM NOLAN
What about the zaps out of high school? They get no free education. When they wash out they are left with nothing to show.
BARTENDER puts some of the glasses in their place
BARTENDER
You guys went to college. The coeds hung all over you. Don't tell me that in high school cheerleaders like Heather and Buffy weren't stroking your bats. The men laugh nodding their heads and slapping high five.
PHIL BOYER
But in college, if your injured you still get to finish your education if you want.
50
ADAM NOLAN
All that stops when you get injured. That's when everyone ignores you. You get treated like used goods.
TOM SUTTON
Man, I was suppose to go to law school. Phil was suppose to go to medical school Now, I got no college degree because I was lead to believe I could finish later after baseball.
ADAM NOLAND
They leave you hanging like a piece of meat. You get demoted to some hick town in Iowa or kicked off the team...then out of the system.
BARTENDER
It can't be that bad, you sit here wearing caps from a league, a team that supposedly screwed you. What's up with that Einstein's
PHIL BOYER
The Diamondbacks did win the World Series Stepping off of a stool, TOM SUTTON, 22, stands. He runs his hand through the back of his hair. He speaks in a somber tone.
TOM SUTTON
It is just unfair, from pampered to garbage People just can't be treated that way It could piss off someone enough to go postal. The other ex-players high five each other. The BARTENDER puts his hands on the bar railing.
BARTENDER
At the same time there has been many great players come out of universities like Arizona State. Rick Monday, Reggie Jackson, Fernando Vina...
PHIL BOYER
It's not ASU or college. It's the pro game. It's hard for people out of baseball to understand what it is like, how it is.
51
The three men raise their glasses in salute. They all take a gulp of their drink. The BARTENDER smirks at them
BARTENDER
Too bad, there's nothing any of you can do You had your chance, your opportunity. It didn't work out, let it go!
ADAM NOLAND stands up and slides his empty glass down the bar. He has an angry look in his eyes. He is growing intense.
ADAM NOLAND
UNDERSTAND...there is always something. They screw you. You screw them HARDER.
PHIL BOYER crushes a beer can and tosses it into the garbage.
PHIL BOYER
Look at the money in the game today. I have no bonus money left for school.
ADAM NOLAN
We wouldn't be sitting in this dump if we made the money today. You don't let cock suckers crush your life. Pay back!
PHIL tosses his crushed beer can into a nearby trash can. The three men yell out in unison. TOM is especially excited.
TOM SUTTON
When they dumped me I could have killed
BARTENDER
HEY NOW, slow down some partner It does no good to get angry now
TOM SUTTON
I'm still angry! NO... I'm pissed!
BARTENDER
You boys are getting too round up You need to eat. Got some Bar BQ The men shake their collective heads no and yell for more beer.
52
35C EXT - DETECTIVE CAR - AFTERNOON - (day 5) 35C
The detectives are traveling to the desert crime scene. DUGAN scans the rock ridges and rugged desert terrain with binoculars.
DET SHELL
This doesn't make sense. A young teenage girl and then a young women. Different M.O., ages, different areas of town. There is something strange about these cases. I'm just glad we're going out to see for ourselves
DET DUGAN
Because of the messages left we need to find out if the victims or families involved are related in someway or reason. Are these random murders or a serial killer? The other thing is if the murders are related somehow then how does this guy know the whereabouts of everyone?
DET SHELL
The deaths are related we just need a connection. There's the milepost maker there. Let's park away from the marker in case the bozo overlooked something out here.
22 EXT - DESERT ROADSIDE - AFTERNOON (day 5) 22
DET SHELL stops on the roadside near the crime scene. They exit the car and walk to the milepost. DET. SHELL notices a brush that appears to have a recent cut. She walks up to the brush and stares at it. DET. DUGAN is walking ahead when SHELL yells out loudly.
DET SHELL
STOP! Look at this.
DET DUGAN slowly turns to SHELL
DET DUGAN
What! You found a pretty flower? Is it you never saw a brush in the desert? DET SHELL is too involved in examining the brush
53
DET SHELL
This appears to be a somewhat fresh cut with a smooth edge. Look around for any possible discarded branches that appears to be cut with an sharp instrument rather than bend over or twisted off.
DET DUGAN
Hey, we're not here on a field trip. What were you a girl scout or 4H club?
SHELL grins as the detectives look around for the missing branch.
DET SHELL
You're funny. At Howard, I remember my botany classes and how one can tell the age of a cut plant. But this is probably over your head
SHELL smiles at DUGAN with respect
DET DUGAN
What college didn't teach you was how to keep a media circus from contaminating a crime scene. Anyone could have broken it off. For all we know the sheriff could have cut a branch to have someone scratch his ass with it.
DET SHELL
The county reports say that tire impressions were lifted. What if a branch was used to cover up the suspect tire tracks that the Sheriff missed because of the obvious tracks left.
DET DUGAN
You're not bad! Looks like you didn't waste daddy's money after all in college. I will have forensics out here to analyze it.
DET SHELL
What about sheriff AHHOE?
DET DUGAN
I'm not looking for a photo op, We need to prevent STRIKE THREE
54
42 INT - THERAPIST OFFICE - AFTERNOON (day 5) 42
RICKEY REYNOLDS lies on the couch for a therapy session. He is 42, but appears younger. He is slim and has slick dark hair. His therapist, DR. BUBLIK, 56, writes notes on a pad. He is agitated as he speaks to her.
RICKEY REYNOLDS
I just HATE the way they treated my boy. They promised him a chance if he left college. He gets injured DOING what they say then they treat him like yesterday's TRASH!
DR. BUBLIK looks at RICKEY intently as she writes. The doctor looks at REYNOLDS who is moving uneasy on the couch.
DR. BUBLIK
Since I have been seeing you your anger seems to be getting worse each time
RICKEY REYNOLDS
My boy couldn't go back to college and play. He had little money to live a normal life.
REYNOLDS pauses but continues upon a nod from the therapist.
RICKEY REYNOLDS
All he knew and cared about was baseball Sometimes it seems like they are laughing. Laughing at him, at me, at us. Not CARING that he no longer had a career.
THERAPIST
Have you CONTACTED anyone in the organization in any way to express your concerns or convictions? He stops moving and looks at her curiously, eyes fixed in a cold stare.
RICKEY REYNOLDS
What do you mean CONTACTING? Therapist looks up from her notes and pauses before speaking, knowing that she must be diplomatic at this stage.
55
THERAPIST
In any manner, letters, E-mail, phone. Perhaps in SOME other way. He slowly sits up and notices a nearby newspaper's headline of the recent murders. Looking long and hard at DR. BUBLIK, he erupts in angry tone.
REYNOLDS
You trying to INSINUATE SOMETHING that you believe I might have done doctor? The therapist has noticed REYNOLDS glance at the newspaper. She attempts to lean back nonchalantly without letting on.
THERAPIST
NO, not at all...I am here to listen to you
REYNOLDS now sits up on the couch firm and erect. DR. BUBLIK reacts noticeably startled and scribbles faster.
REYNOLDS
They are ALL involved, EVERYONE! They screwed my boy and now I'm angry. Almost every time I listen to a baseball game the rage peaks. The therapist regains her composure and puts her note pad down.
DR BUBLIK
Who is THEY? Expand on that for me. How he was hurt. How did THEY screw him?
RICKEY REYNOLDS
They hurt him bad. He suffered.
REYNOLDS looks the therapist straight in the eye as his eyes moisten. He blinks rapidly to clear his eyes. His speaks softly.
RICKEY REYNOLDS
From the clubhouse man to the very top They lied, mislead him, deceived US. He ended up taking his life just two months ago while watching a baseball game, dam it.
DO YOU UNDERSTAND! HIS LIFE!
56
The therapist notes the intensity of REYNOLDS anger. She attempts to mask her concern. REYNOLDS starts breathing heavy. REYNOLDS lays down looking over at her with a cold blank stare. She sits uncomfortable.
RICKEY REYNOLDS
Their time is coming. Anything can happen. Bad things happened to my family. Bad things can happen to their families!
DR. BUBLIK
You can always hire a lawyer to...
REYNOLDS sits up quickly and waves her off.
RICKEY REYNOLDS
It I had one life to give for my country it would be a lawyers
He lets out a sly smile as the timer goes off. There is an eerie feeling in the air as both stare at the table where the timer is located. Nothing is said by either for moments. REYNOLDS finally stands up, stretching his arms.
RICKEY REYNOLDS
MY time is up, isn't it? I better be on my way. She nods in agreement as REYNOLDS lingers to the door. Her eyes follow as she blindly grabs for her micro tape recorder as the door closes.
DR. BUBLIK
Although the son's death has been discussed in detail the dad is still very much angry. It appears Dad is very capable of committing a somewhat hateful event if not monitored...
Dr. BUBIK looks out the window. She stares at the nearby newspaper.
DR. BUBLIK
...Hopefully he has yet to act out. I ponder the thought of contacting authorities with my concerns and suspicions versus my ethical obligation of confidentiality.
57
43 EXT - OUTSIDE THERAPIST OFFICE - DAY (day 5) 43
RICKEY REYNOLDS walks quickly to a parked black Pathfinder. He opens the door. Reaching in he grabs a baseball cap puts it on.
18E EXT - DESERT LANDSCAPE - MORNING (day 6) 18E
Sheriff AHHOE is holding a news conference near the desert site where the young body was found. Media trucks, some with live remote satellites stand at the ready. Reporters scramble to get positions upon seeing the sheriff preparing to speak.
SHERIFF AHHOE
When I last met with you folks, things were bleak in our community. Early this morning my office, my detectives, we arrested the person we believe to be responsible for this heinous crime out here not too long ago.
MALE REPORTER ONE
Can you tell us about the person arrested?
SHERIFF AHHOE lets out a huge smile at the attention
SHERIFF AHHOE
Due to my detectives tireless efforts I can tell you that he left tire marks at the scene. Second, he did confess to being at the scene the night of the killing. He is a cap vendor for the baseball team in Tucson which is the farm club of the major league Diamondbacks. You do the math!
FEMALE REPORTER TWO
Does this mean that the females in the valley of the sun, our communities, are now safe due to this arrest?
SHERIFF AHHOE
My office does fine and difficult work. I have every confident in this arrest. We are not in the business of arresting anyone without having a good solid basis. He is a suspect only in the desert case.
58
Reporters and civilians in the area clap at the announcement. SHERIFF AHHOE leaves the podium all smiles. He stops for photographs with spectators. He shakes hands of all offering congratulations as he walks.
41A INT - SPARKY'S SPORTS BAR - AFTERNOON (day 6) 41A
DUGAN and SHELL enter the sports bar for lunch. They stop and admire the photos and sports memorabilia on the walls and in displays. The detectives move to the bar as SHELL motions for the bartender.
DET DUGAN
Did you believe the home run race? There was no race. The only question was whether the Arizona State man, BARRY BONDS broke the record.
DET SHELL
Yeah, but wasn't it fun to see our guy, GONZO hit so many? -Almost 60?
BARTENDER interrupts as he wipes the bar in front of the detectives. He hands them a lunch menu and then some water.
BARTENDER
Gonzo. Luis Gonzalez, 2001 world series hero. What a nice player!
DET DUGAN
Any guy who has young triplets and hits that many home runs is the MAN.
DET SHELL
Don't forget his wife, she has to take care of them when he's on the road.
DUGAN and BARTENDER nod their approval
BARTENDER
I can't say all the players in here always act like men but enough about baseball. Did you hear about the girl in the desert?
Detectives look up from menus and at the BARTENDER with curiosity.
59
BARTENDER
You guys been in a time capsule? SHERIFF DON gave a news conference not to long ago saying how his office caught the killer of that girl out in the desert
The BARTENDER moves away to help another customer
DUGAN
Let's go see how he screwed this one up.
They get up from the bar and turn to walk as the BARTENDER yells
BARTENDER
Wait! I didn't mean to take your appetite.
44 INT - LIVING ROOM (KLINES) - AFTERNOON (day 6) 44
SHERIFF AHHOE is having coffee with KLINES. The Sheriff is gloating.
TOM KLINES
We decided to call you when we heard the arrest concerning the girl in the desert
SHERIFF AHHOE
Well thank you for your confidence. My staff does a wonderful job with so little to work with.
TOM KLINES
Now that we know the girl in the desert is JOHN GEORGE'S missing girl, TAMMY, Add the MELISSA DECKER murder. Now our girl CARMEN is missing...
He pauses as he notices the sheriff appears pre-occupied with matters.
TOM KLINES
...It's not public knowledge but we, in the DIAMONDBACKS organization believe that there is a connection with the team
SHERIFF almost spills his coffee in excitement. He stands and motions for his assistant to take notes.
60
SHERIFF AHHOE
Let me get this clear, you guys think some loony out there has focused on the Diamondbacks organization.
TOM KLINES
I assume the killer would be "loony". Considering the recent killings we do fear for the worse. We all work for the Diamondbacks in some capacity. JOHN GEORGE is the assignment director. He informs all of the youngsters if and where they will be assigned in the minors...
KLINES pauses as a sheriff aide approaches the sheriff and whispers in his ear. KLINES continues when the Sheriff returns his attention to him.
TOM KLINES
...ROBERT DECKER is in player development in the minors. He helps let the team in the show know which players are on and which are having trouble adjusting from injuries or just from the level of competition
The aide nods his head. AHHOE lifts his hand to halt KLINES
SHERIFF AHHOE
I am sorry to interrupt but I need to be elsewhere urgently. Sir, I can tell you that it is not public knowledge yet as to the TAMMY GEORGE identity.
TOM KLINES
Yes I am sure you are a very busy man but we're not dealing with the public we're dealing with my daughter. We know what is happening in the valley of the sun.
SHERIFF AHHOE
I try not to ever be too busy for the fine citizens of this county. You have my word I will give special attention to these matters. Let me get back with our man who confessed.
61
45 INT - COURTROOM - MORNING (day 7) 45 A Superior Courtroom is filled with observers, media, law enforcement,
as DUGAN and SHELL sit in the rear. An expedited evidentiary hearing is reconvening. The issue is the admissibility of the confession from the driver in the desert. Sheriff AHHOE sits with the prosecutor smiling for the media. He puts on his game face by glaring at the defendant. The media have cameras filming. Artists draw still renditions of the events. A Sheriff's detective, JONES, takes his seat on the witness chair to testify.
JUDGE PATCH
Mr. SANCHEZ please continue
SANCHEZ puts his papers aside and addresses the witness.
DEFENSE COUNSEL SANCHEZ
Interviewing a suspect takes skill and practice?
DETECTIVE JONES
Not really, sometimes one acquires a knack. One has to know how to communicate with a person so that that suspect feels comfortable
DEFENSE COUNSEL SANCHEZ
You received training on how to interview a suspect?
DETECTIVE JONES
Yes, at the academy
DEFENSE COUNSEL SANCHEZ
You have attended seminars and training on interview techniques after the academy, correct?
DETECTIVE JONES
Yes, about six months ago was my last training
DEFENSE COUNSEL SANCHEZ
You would agree that there are at least thirty different techniques of how to interview and to get someone to crack, to talk, to confess?
DETECTIVE JONES
Different officers have different personalities so one method might not fit a certain officer
62
DEFENSE COUNSEL SANCHEZ
An officer can be trained on interview techniques through attending seminars or training?
DETECTIVE JONES
Yes, I could agree to that
AHHOE shifts uncomfortably in his chair as SANCHEZ reviews notes. Upon reaching a certain page he continues his cross-exam.
DEFENSE COUNSEL SANCHEZ
Techniques to get someone to talk include "incentive approach"; the "fear-up" ; the "fear-down" and the "pride and ego down"
DETECTIVE JONES
Those would be familiar
DEFENSE COUNSEL SANCHEZ
The "incentive approach" can work with a smoker who hasn't been able to smoke, true?
DETECTIVE JONE
I suppose it could be worked that way
DEFENSE COUNSEL SACHEZ
"Fear up" might employ heavy-handed table banging, an overpowering manner with a loud or threatening voice, perhaps a touch of throwing an object across the room to heighten the interviewee's implanted feeling of fear, true?
DETECTIVE JONES
That could be another technique some my use
DEFENSE COUNSEL SANCHEZ
Isn't true that an interrogator could also suggest plenty of things to scare someone into cooperating by presenting a scenario where fellow prison inmates might view someone killing a child lower than a child molester.
PROSECUTOR MARTIN rises out of his chair to object
63
PROSECUTOR MARTIN
OBJECTION! Speculation! I have been lenient to defense to see if he will get to a question that doesn't beg for speculation
JUDGE PATCH
Overruled! I believe counsel is simply showing there are different techniques that detectives could have used to illicit a coerced confession. Detective, you can answer the question.
DETECTIVE JONES
I don't suggest anything. I deal only in facts
DEFENSE COUNSEL SANCHEZ
Well then, isn't it a fact that there is no one objective person in the interview room to mediate what degree of physical or mental pressure is asserted towards a suspect?
DETECTIVE JONES
Only the subject and detectives are present but we sometimes record or tape the interview.
DEFENSE COUNSEL SANCHEZ pauses for a moment
DEFENSE COUNSEL SANCHEZ
Only the detective decides what position to put the subject in DURING the interview, such as chaining his legs to the chair, handcuff his hands behind the back, or have him stand?
DETECTIVE JONES
The detective decides, yes?
DEFENSE COUNSEL SANCHEZ
During our interview you stated one technique used is what is being referred to in this hearing is a method termed "implanting".
DETECTIVE JONES
That would be correct
64
DEFENSE COUNSEL SANCHEZ
This would be where the officer repeats facts over and over and the suspect may be shown photos to a point where the facts are conformed or "implanted" into a memory or thought process of a suspect?
DETECTIVE JONES
I have no idea what makes a guy tick. What you asked would be a very generalized, even vague summation of a method that a detective might use.
DEFENSE COUNSEL SANCHEZ walks up to the stand.
DEFENSE COUNSEL SANCHEZ
YOU were not only trained in the "implant" method but YOU have used that method?
He stands directly in front of JONES blocking his view from prosecution.
DETECTIVE JONES
Yes, at times
DEFENSE COUNSEL SANCHEZ
In fact, YOU have adopted the "implant" method in YOUR interviewing practice.
DETECTIVE JONES
At times, but I generally use a more direct method of simply being nice to a suspect
DEFENSE COUNSEL SANCHEZ
YOU used the implant method in THIS case?
DETECTIVE
Well... I don't recall
SANCHEZ walks to defense table picking up a tape recorder.
DEFENSE COUNSEL SANCHEZ
You have already indicated the interview was recorded. Parts of that same interview that someone released to the media, isn't that true?
65
SANCHEZ glances over his shoulder towards the sheriff.
DETECTIVE JONES
Yes it was recorded but I don't know how it was released to the media
DEFENSE COUNSEL SANCHEZ
Would you like a copy of the newspaper or would me playing a portion of the interview help refresh your memory as to the technique used?
A stuttering DETECTIVE JONES nervously answers as SANCHEZ moves to the table and picks up a newspaper.
DETECTIVE JONE
Yes, the tape could help
SANCHEZ drops the newspaper on the table causing a loud echoing sound startling the media. He moves to the tape recorder. It is played for the court: TAPE RECORDING
DETECTIVE JONES
"Look, we have all been here for awhile. The facts have been covered and I'm hungry".
The tape is stopped. SANCHEZ looks to JONES.
DEFENSE COUNSEL SANCHEZ
You will confirm this is your voice and That this is your statement on this recording?
DETECTIVE JONES
It sounds like me
DEFENSE COUNSEL SANCHEZ
You will confirm this is YOUR voice AND YOUR statement on this recording?
DETECTIVE JONES
Yes
The tape recording is played again: TAPE RECORDING
66
DETECTIVE JONES
"You parked on the dirt, off the road".
DUNCAN
"Yes I stopped to see if I could help someone whose vehicle I thought was broken down"
DETECTIVE JONES
"Tell me why the ONLY tire tracks found at the crime scene match only your vehicle"?
DUNCAN
"I can only tell you what I know"
JONES
"Look at me, do you see anything that says I am an idiot. You were the only one there. and I AM TIRED of your bullshit!"
DUNCAN
"I thought I could help police if I came in and reported..."
DETECTIVE JONES
"STOP LYING! Your just trying to save your backside from frying. You're getting me sick You know you only reported being there just in case someone else reported seeing you there".
DETECTIVE JONES looks at DON AHHOE sheepishly.
DUNCAN
"Can I have a cigarette? It's been hours"
DETECTIVE JONES
"Now you're whining like a baby Just admit it like a MAN! You are a man aren't you?"
A loud slamming sound is heard on the tape
DETECTIVE JONES
"You already told us of the facts at the the scene just like the evidence shows us"
67
DUNCAN
"I didn't get out of my car. I didn't see. Can I go to the restroom? Please"
DETECTIVE JONES
"This would be a good time to break. You stay here and THINK about what you WANT to tell us".
Tape is shut off. DUGAN hangs his head in the silent courtroom.
DISSOLVE
The driver, DUNCAN, sits nervously as he is now testifying on cross-examination. The judge nods for him to proceed.
PROSECUTOR MARTIN
Did you tell the sheriff's office that you had seen a SUV parked out in the dessert?
DUNCAN
Yes. I told them it was black Nissan Pathfinder, last two numbers were possibly an eight and six or the other way around
PROSECUTOR MARTIN
You claimed you saw this alleged vehicle the day or two before YOU went to the sheriff's office in response to hearing about the missing girl, MS. GEORGE?
DUNCAN
The sheriff is always talking about having the community involved and helping out. I thought I was helping out some.
PROSECUTOR MARTIN
How did the sheriff's office respond?
DUNCAN
They rushed me into a little room. Just had a table and a chair. They said it would only be a few minutes They lied to me.
68
PROSECUTOR MARTIN
You DID consent to an interview? No one applied any force against you?
DUNCAN looking puzzled.
DUNCAN
Yeah, I agreed to talk to them. I was not forced but it took more like eight hours before they let me go. I missed work, got fired.
PROSECUTOR looks quickly to the judge
PROSECUTOR MARTIN
Your honor, would you please admonish the defendant and instruct him only to answer to the specific question asked to him?
JUDGE looks over to DUNCAN as he looks back at the Judge
JUDGE PATCH
Mr. DUNCAN you shall answer only to the question that is posed to you and no more
DUNCAN understands and nods in the affirmative.
PROSECUTOR MARTIN
During the interview what foods did you eat?
DUNCAN
Just some peanuts. I kept asking, telling them I needed to eat or I would get ill...
PROSECUTOR out of frustration turns to the Court and pleads.
PROSECUTOR MARTIN
Your honor, you just admonished Mr. DUNCAN and yet he chooses to ramble on
JUDGE PATCH
I actually find his statements very interesting and helpful to the fact finder, ME. I will let him continue in the interest of justice. Please continue Mr. DUNCAN.
69
PROSECUTOR appears flustered and walks to his table.
DUNCAN
They ignored me or promised food if I talked. They gave me a sandwich with green baloney. They gave me water but it was warm.
Judge glares at the sheriff before nodding for DUNCAN to resume.
DUNCAN
Gave me one cigarette. I smoke a pack a day
PROSECUTOR MARTIN
During this time, they treated you good?
DUNCAN
One was real nice.
PROSECUTOR smiles and turns his back heading for his seat.
PROSECUTOR MARTIN
Would that be DETECTIVE JONES?
DUNCAN
Oh no! I didn't know his name at the time but seeing him, he was mean, REAL mean. Always in my face no more than two inches away
The PROSECUTOR fumbles with his notepad as he glares at the Sheriff
PROSECUTOR MARTIN
YOU did make a confession on a tape recording. Why would you do that if your were not involved?
DUNCAN
Yes, I did make a statement but I felt that it was the only way. I wasn't allow to call my boss even when JONES kept turning the tape machine off. That's when he really got in my face. He would tell me things about the scene. He kept pounding the table, throwing things and yelling that I was not telling the truth. That we could stay as long as it took for me to give him the right answers.
70
PROSECUTOR jumps up and waves his arms
JUDGE PATCH
You asked the WHY question. Now give him an opportunity to answer. Sit down counsel!
PROSECUTOR looks stunned and dutifully sits down in his chair.
DUNCAN
They promised me I could eat and smoke if I would talk into the machine No toilet. No phone calls unless I talked
The judge glares at detective JONES.
PROSECUTOR MARTIN
But no one forced you, by physical force or with threats of physical violence, before you decided to give a confession?
DUNCAN
I guess what is force or torture is subject to interpretation. They made it clear that I would go to jail for a long time and what would happen to me there. That I could help myself if I would only tell them what happened. I figured out what they wanted to hear from the blurry photos on the walls they kept showing me. Plus from what they kept telling me about. I just said those same things they kept telling me
JUDGE pounds his gravel on the desk
JUDGE PATCH
I have heard enough, Frankly, the testimony of the detectives leads me to believe there has been a shading of the truth in an attempt to excuse an absolute disregard of the highest law of the land. On the other hand, Mr. DUNCAN convinces me...
PROSECUTOR MARTIN rises from his chair and raises his hand.
PROSECUTOR MARTIN
Excuse me your honor, but I have more...
71
JUDGE PATCH
Save it counsel...I am convinced that this confession is coerced, involuntary and against Mr. DUNCAN'S free will. That no reasonable man could have or should have had to endure what Mr. DUNCAN has had to suffer through.
PROSECUTOR MARTIN
They acted in good faith your honor
JUDGE PATCH
Many a time, the public hears that a person is set free on account of the court's blunders. However it has been said that there is another consideration -the imperative of judicial integrity. If the result is that a criminal goes free, it is the law that sets him free. Nothing destroys a government quicker than its failure to observe its own laws, or worse, its disregard of the charter of its own existence.
PROSECUTOR meekly sits down moving his chair away
JUDGE PATCH
Here, the police conduct was appalling! The confession is garbage. It is my ruling that the confession is inadmissible!
Sheriff DON AHHOE throws his pen on the desk and stands causing his chair to tear away from him like a rocket. JUDGE PATCH catches a glimpse of his conduct
JUDGE PATCH
Counsel! Get the sheriff's traveling circus out of here before I hold him in contempt of court for wasting the court's time and you in contempt for prosecuting this borderline frivolous witch hut. What is most disturbing here is the state's reliance on the utter inconsistency between government witnesses testimony.
The judge slams his gravel and storms out of the courtroom. DUGAN and SHELL stand to exit the court. They look over in disgust towards the sheriff. They watch in pleasure as the media finishes recording the courts' belittling of the Sheriff.
72
46 EXT - PHOENIX STREETS -MORNING (day 8) 46 A woman driving from Canyon Lake on a desert road listens to the radio
RADIO
"In legal matters, the court threw out the alleged confession of the Sheriff's suspect. nn the desert case. Authorities ask that you be on the look-out for a late model black Nissan Pathfinder, dark tinted windows, with the last two number of the license plate being eight and six or transverse."
As she passes a local mining area along the desert road she sees a black sports utility vehicle with dark tinted windows pull out. The vehicle cuts in front of her. She notices that the last two numbers on the license are eight and six. Instantly she is horrified and dials 911 on her phone.
911
911 what is your emergency? The woman excitedly blurts out her information
WOMEN CALLER
I found the SUV you guys are looking for. It's black, a Nissan Pathfinder and the last two numbers on the license plate are eight and six. The windows are tinted dark.
911
What is your location?
WOMAN CALLER
I'm southbound at the exit of Mining place on highway 87. I'm behind the SUV in a blue Toyota Sienna mini van
911
Please do not try to stop this vehicle Officers are responding to that location
Two Maricopa County patrol cruisers with flashing lights immediately respond to an intersection. They wait for the approaching vehicles.
As the SUV passes they converge to make a felony stop on the Pathfinder.
73
The officers race out of their units with guns drawn. They approach either side of the pathfinder yelling out instructions.
DEPUTY SHULTZ
Put your hands up where we can see them. Open the door and step out with your back to us.
The door opens very slowly. The driver's leg in dark pants is extended out before pausing. After a moment, the driver backs out of the Nissan. The driver is wearing a dark long sleeved shirt over broad shoulders. A black baseball cap covers blonde hair with a ponytail sticking out. More officers arrive and take positions surrounding the vehicle.
DEPUTY SHULTZ
Now lay on the ground with your arms extended out in front of you.
The driver obliges and is spread eagle in front of on lookers, police and a television news helicopter. Officers pounce on he driver including an officer who has a foot on the drivers neck firmly against the hot pavement while another officer handcuffs the driver's wrists behind the back.
The driver is roughly raised off the ground as officer point weapons in the driver's direction. As officers step away, the driver is a blonde female.
Officers frisk her squeezing the shoulder areas before removing shoulder padding from those areas. She is taken into custody.
47 INT - TEMPE POLICE STATION - AFTERNOON - (day 8) 47
SHELL hurries along the interior of the police station stopping only upon reaching DUGAN'S office. She rushes in with a piece of paper.
SHELL
Sheriff's office might have found the SUV that DUNCAN was talking about, a black Nissan Pathfinder with the last two numbers, eight and six.
DUGAN leans back in his chair and puts his feet on his desk. SHELL'S excitement is tamed by his lackadaisical attitude
SHELL
WHAT! You know something? What! Tell me.
74
DUGAN
It's the right license plate!
DUGAN puts his hands behind his back and intentionally yarns causing SHELL to move closer to his chair. Her eyes unsure what to make of him.
DUGAN
Turns out the front plate was stolen! Reported it two weeks ago. The driver's been camping out of town for ten days. Her story checks out. She was near the city limits when she was stopped by the sheriff's office.
Despaired, SHELL sits down in DUGAN'S office.
DUGAN
I'm skipping out early today, taking the girls to the twilight game. The big unit is pitching. It's the one of the last ones before they hit the road. The regular night games let out too late for the girls. I just hope LYNN gets home in time after her band practice.
SHELL
Well have a good time because we have to do something before there is a strike three.
48 EXT - OUTSIDE SCHOOL - AFTERNOON (day 8) 48 A small group of girls break from a huddle dispersing in different directions. LYNN walks alone exiting the fenced schoolyard. A black Nissan Pathfinder sits under the shade of a tree across from the school. This vehicle approaches LYNN slowing to a crawl as it reaches her location. She becomes visibly nervous with wide eyes. The SUV proceeds past her. LYNN cautiously observes its movement. It stops for a waving child with a bright smile who climbs into the vehicle.
49 APARTMENT PARKING LOT - EARLY A.M. (day 9) 49
The apartment complex has several multi-story buildings. A person wearing dark clothes, long sleeves and a baseball cap darts out of the shadows between two buildings. The subject struggles carrying an object rolled in wrapping. This person lumbers crossing the parking lot.
75
50 EXT - DUMPSTER AREA - EARLY A.M. (day 9) 50
Stopping between two dumpsters the person heaves the object up disposing it into a dumpster. A loud sounding thump is made.
51 EXT -APARTMENT GRASS AREA -EARLY A.M. (day 9) 51
FELIPE, 56, gray unkempt facial hair, homeless, sits on a crate having watched the person with the object. JOSE, 51, a homeless friend lies half-asleep on a cardboard. His hair is lose and disheveled from sleeping. FELIPE whispers to JOSE.
FELIPE
What was that dude carrying? Whatever it is looks long and heavy
49A EXT - APARTMENT PARKING LOT - EARLY A.M. (day 9) 49A
Seconds past without the subject reappearing from between the dumpsters. Suddenly the person reappears from the dumpster area hurrying back to the shadows between the buildings.
51A EXT - APARTMENT GRASSY AREA - EARLY A.M. (day 9) 51A
FELIPE stands up excitedly from sitting on his crate.
FELIPE
The dude took off like someone lit a fire under his ass. He really booked out of there.
JOSE looks out from under a matted blanket as FELIPE crouches down.
JOSE
Maybe it's just old carpet.... Soiled like your filthy underwear
JOSE laughs at his joke as FELIPE looks disgustedly at JOSE.
FELIPE
That's not cool. Something don't seem right. I might have saw something bad
JOSE
Fool, it's almost a football field away.
76
FELIPE stands up waving for JOSE as he points in the direction of the dumpsters. JOSE grudgingly stands looking quickly.
JOSE
It's dark outside, bad lighting. I'm hung over and I'm tired... Did you see him because I can hardly see your ugly face?
FELIPE
The dude had the thing over a shoulder. It covered the face from this angle. I think he came from one of those buildings with the baseball players.
JOSE
You're like a little girl, whining about this and that....
JOSE lies back down on his back and shakes his head. FELIPE bends over to get closer to JOSE
FELIPE
You never take me serious. And I'm serious as a heart attack!
JOSE
Heart attack? Good, take two aspirins and wake me in the morning IF you're still around to bother me.
FELIPE moves back to the crate to sit down.
FELIPE
You think I should call five 0?
JOSE
YEAH...here use my cell phone. You idiot...they don't want nothing from an old fart like you. Besides those players throw out good food.
FELIPE
I tell you it is just not right
77
JOSE
Yeah, it is not right that you're bothering me. Plus you're waking up the neighbors.
FELIPE gets off his crate and stands boldly.
JOSE
If I knew you were going to bitch so much I would have just stayed with my old lady. At least her excuse is that she's Bi-polar!
FELIPE winds himself into a frustrated pose.
FELIPE
I have the good mind to walk over there and see for myself. ...
JOSE in a frustrated and angry voice
JOSE
What mind? There's nothing good about your mind. You're out of your mind. You're mucho loco remember That's why you get disability!
JOSE covers himself with his matted blanket. FELIPE takes a couple of steps and turns to look at JOSE.
FELILPE
You better come with me... You know just in case it's bad!
JOSE moves the blanket and gives a dirty look to FELIPE who maintains a vigil looking at the dumpster area. FELIPE whispers
FELIPE
I can't tell which building he went into. But it looks like he just went between those two buildings
JOSE
Hey Sherlock, We use that dumpster and we don't live there. Go to sleep, it's way to early to wake up
78
50A EXT - DUMPSTER AREA - SUNRISE (day 9) 50A
A BAG LADY, 40ish, heavy with a large rear end is pushing a shopping cart. Accompanying her is a male in his 50's. They stop at the dumpster.
DUMPSTER DIVER
It's your turn to dive. You need to hurry cause the sun is coming up soon He cups his hands to lift her. The BAG LADY leaps up as the he strains. The BAG LADY leans over the edge of the dumpster with the discarded object. Reaching into a heap of trash she tosses aside a purple ball cap.
BAG LADY
You don't need a baseball cap do you? Yeah, I need your help, I got something big rolled up in here.
DUMPSTER DIVER
Sure it's not that fat ass in your pants?
The dumpster diver laughs through his bad and rotten teeth.
BAG LADY
Funny, look I can't tell what it is. I'm going in deeper. Watch for the police
She jumps into the dumpster and stands over a purple wrapped object. She struggles to unwrap the object but is having extreme difficulty.
BAG LADY
It's stuck
DUMPSTER DIVER with a confused look on his face inquires
DUMPSTER DIVER
You got your big ass stuck in a dumpster?
BAG LADY
NOT ME! I'm having trouble getting this lose. It smells kind of bad.
DUMPSTER DIVER
Well if it smells as bad as you do
79
The BAG LADY creates enough opening of a purple wrapping to expose a body covered with maggots. She jumps up and out of the dumpster. She is yelling as keeps on walking, half running away. The dumpster diver runs after the BAG LADY as she hurries off passing a moving vehicle.
DUMPSTER DIVER
Hey wait, ...I'm sorry I didn't mean to make fun of your big fat smelly ass.
51B EXT - GRASSY AREA - MORNING (day 9) 51B
FELIPE leaps off the crate upon hearing the yelling.
FELIPE
See something is wrong at that dumpster.
JOSE peeks up from the blanket.
JOSE
That veija is running like she just saw you when you wake up Go back to sleep
50B EXT - DUMPSTER AREA -MORNING (day 9) 50B Partially unwrapped in the dumpster is a petite long blonde haired female body. DUGAN and SHELL step on stools and peak in noticing maggots in and near crevices. They observe a bloodstain at one end of the wrapping. They stare at blood droplets on the exposed back.
SHELL
Could those be low velocity blood drippings?
DET DUGAN
That's what I'm thinking.
SHELL observes the interior walls of the dumpster
SHELL
Obviously, without any high velocity blood spatter and the minimum pool of dry blood this is not the original scene
DUGAN and SHELL step off of their stools and look around
80
DUGAN
Who is the responding officer?
SGT KARA SHAW comes out from behind a dumpster reviewing her notepad. Without looking in their direction she inquires
SGT SHAW
Did you notice that her foot was severed?
SHELL and DUGAN look at each other in surprise.
DET SHELL
We just glimpsed inside. Was it found?
SGT SHAW
I didn't go in, just did a superficial search and I found nothing. Just a wrapped body.
DET DUGAN slowly takes off his sunglasses. He looks at SHAW.
DET DUGAN
Make sure no one else enters or even looks into that dumpster unless it's forensics. Those drippings are critical. I don't want anything in this area comprised. Can you tell me HOW the body was found?
SGT.SHAW
Someone called 911 at 0645 about seeing a woman yelling and running down the street at about 0500 hours. It was reported that there was a man chasing her
DET SHELL
An hour and forty-five minutes! Why the rush?
SGT.SHAW
She had to think about it before calling When I got here I looked in the dumpster.
51C EXT - GRASSY AREA - SUNRISE (day 9) 51C
JOSE and FELIPE are gathering their personals readying to leave.
81
JOSE
Hurry up. You're slower than a woman. I don't want to talk to five-0 again. They already ruined my sleep.
FELIPE tries to look at the officers without being noticed.
50C EXT - DUMPSTER AREA - SUNRISE (day 9) 50C
SGT SHAW
The women yelling was a bag lady
DET SHELL
So the caller just ignored her?
SGT SHAW
Kinda. The caller didn't think much about it until seeing the news with Sheriff DON. That's when she decided to call just in case.
DET DUGAN
Was the body dumped from a car? SGT SHAW points to where JOSE and FELIPE are.
SGT SHAW
Those fellows say early this morning someone carrying an object came out from between those two buildings. Couldn't give a description since the object blocked his view.
DUGAN
That could explain the dry blood then the fresher drippings on the body. The foot was severed elsewhere. Let's seal the buildings off if it's not too late. Is there anything else? SHAW looking confused goes over her notes.
SGT SHAW
I did find a baseball cap near the body
DET SHELL
Any chance that it would be diamondbacks?
82
SHAW reacts stunned to the question but is impressed
SGT SHAW
Yeah, it was a purple one with a obvious fingerprint on the cap bill. I did bag it for evidence since it was clear it was not one discarded for wear and tear.
DET SHELL does a double take that DUGAN notices
DET DUGAN
Anything else we should know about?
SGT SHAW
Now that you mention it. I don't know if it is relevant or not but on a dumpster flap, there appears to be written graffiti.
SHELL and DUGAN look at each other than at SHAW
SHELL
Can we see it please?
SGT SHAW
It's over here on this other dumpster.
The law enforcement trio make their way to the other dumpster.
DET DUGAN
Have forensics look at every inch of both of these dumpsters, focus on stains and fibers on the wrappings. Set a parameter around those two buildings Talk to the neighbors , managers and see who's on the lease, who visits.
At the other dumpster SHAW motions to another officer to lift the flap.
SHELL and DUGAN read it "STRIKE THREE".
52 INT - APT BLDG HALL (PLAYERS) - MORNING (day 9) 52
Police are knocking on every door, floor by floor. Two officers walk up to apartment 7A and knock The door is opened by a female partially clan in a teddy, nylons held with a garter belt.
83
OFFICER MARSHALL
Miss, did you hear any machinery? Perhaps early this morning or last night?
ANGEL KAY
Nothing, I was ENTERTAINING and had the music blasting. Also I had a little bit too much to drink. I could have had an elephant bouncing off of my ass and not have noticed
ANGEL flirtatiously positions herself to give the officer a glimpse of her barely covered bottom.
OFFICER ELLIG
Any chance you might have heard machinery some other recent time?
ANGEL runs a hand through her hair as she changes positions.
ANGEL KAY
YEAH, YEAH, last night or a day ago, maybe two, three doors down. Anyway it sounded like a saw cutting something. A foul odor too ...but then a lot of players live here. Yet they are so nice
OFFICER MARSHALL moves down the hall and points to a door.
ANGEL KAY
That one or the next one.
OFFICER MARSHALL whispers over to ELLIG
OFFICER MARSHALL
This could be something. Better get the detectives out here
41B INT - SPARKY'S BAR - NOON (day 9) 41B
Two uniformed officers approach the BARTENDER
OFFICER STARKS
Did you talk to detectives recently?
84
BARTENDER
I don't remember talking to any police
OFFICER STARKS
They were detectives, a male and female. You mentioned players with attitudes
BARTENDER
We have players, some nights more than others with an attitude. They don't live too far from here. A lot of the jocks live or hang out at the apartments down the street.
The officers glance at each other knowingly.
OFFICER STARKS
Do any express their frustrations or anger?
BARTENDER
Are you talking about the married ones? The jocks are no different than anyone else. They come for a brewski or three, mouth off how the world sucks, how they got hosed and then they go home.
OFFICER STARKS
Say ballplayers...about their experiences. Like when they get cut, demoted
BARTENDER thinks, moving his head until he snaps his fingers
BARTENDER
Not too long ago, a few days maybe a week a few of the players were getting pumped up.
A glow, like one might find at the end of a rainbow, comes upon their face
OFFICER STARKS
Pumped up about what?
The BARTENDER washing out dirty mugs thinks for a moment
BARTENDER
Mad at baseball to the point I had to calm them
85
OFFICER STARKS
THEM? Can you give us some names?
BARTENDER
NO CAN DO!
OFFICER STARKS Is there a reason you can't name them
BARTENDER
They come and they go. This isn't where everyone knows their name.
The BARTENDER walks away, wiping down the bar inch by inch
49B EXT - APARTMENT PARKING LOT - AFTERNOON (day 9) 49B
DUGAN is being briefed from various sources as officers approach and leave. DUGAN motions for a circle.
DET DUGAN
We narrowed it down to this building. Get it down to a couple of apartments?
OFFICER ELLIG
We have reports of screams but it's unknown If they're screams of danger or adventures
The group snickers and laugh. SHELL reviews her notes
DET SHELL
Screams from 12D -ADAM NOLAN. 22B- folks heard loud noises like machines but just not clear which day - a PHIL BOYER. I believe the best bet is 7C. Someone heard a saw like machine cutting for some time
OFFICER STARKS
Neighbors have provided names
DET SHELL looks over her notes again
DET SHELL
Apparently we do not have a name for 7C.
86
OFFICER MARSHALL
I tried 7C earlier, no one was home then. The door opened when I knocked and I did go in for officer safety. Noticed a circular saw that had a bad smell. Plus the same bad smell in the freezer.
DET DUGAN rolls his eyes and looks at MARSHALL in disgust
DET DUGAN
Did you expect to find him in the freezer? Were you just grabbing an ice cream? You better hope this is not our guy. You might have just blown this case
SHELL and DUGAN walk away quickly and enter the building.
44A INT - KLINES LIVING ROOM - NIGHT (day 9) 44A
TOM KLINES sits in his favorite chair smoking a cigar. He gets up and walks to the radio turning it on.
RADIO VOICE
"...in further developments sources believe that the death of the 14 year old girl in the dessert, TAMMY GEORGE may be related to the death of MELISSA DECKER. In new developments, police have just discovered a body. However, at this time the sources refuse to say if there is any relationship...."
He turns off the radio and rushes to the phone. He dials the Sheriff.
OPERATOR
Sheriff's, what is the reason for your call?
TOM KLINES
I need to speak to the sheriff. He never followed up on the information I was telling him about the deaths regarding families of the baseball team.
OPERATOR
I will have a detective call you right back.
87
TOM KLINES
My daughter is missing. She has a tattoo on her left ankle. Has a body been found?
OPERATOR
Sir, as I said a detective will...
TOM KLINES
Get someone who knows what they're doing. Do you think YOU can do that for...
CLICK...silence. KLINES throws his phone at the wall, he blurts out
TOM KLINES
Who the hell is running the asylum at the sheriff's office?
53 INT - FORENSIC LAB-NIGHT (day 9) 53
Criminalist, NORA RIGGS, concludes latent print comparisons on the outer wrappings. She completes her notes and grabs the phone. She dials.
54 INT - RESTRAURANT - NIGHT (day 9) 54
DUGAN sits with wife, well dressed, in a booth with romantic candlelight. They are looking at menus when his cell phone rings. RING...RING
DUGAN puts his menu down and looks at his phone. He motions that he has to answer the phone. She understands and nods.
DUGAN
Honey, I'm sorry I better get this it's from the lab
WIFE
Don't take too long, It's our special day!
DUGAN
DUGAN here, do you have anything?
VOICE OF NORA RIGGS
Hi, NORA RIGGS, forensics. I know the word was not to bother you on your anniversary, but I was told to contact you immediately if we found anything.
88
DUGAN motions excusing himself and squeezes out of the booth walking to a isolated area. He whispers into the phone.
DUGAN
It's okay, give it to me
53A INT - FORENSIC LAB - NIGHT (day 9) 53A
NORA RIGGS sits at her lab table reviewing her notes and findings
NORA RIGGS
In the dumpster case, the cap and wrapping had a useable latent. We ran them through the AFIS data bank but so far no hits. Need to compare them with a suspect who has some recording of fingerprints somewhere.
VOICE OF DUGAN
Was anything done with the blood dripping? Was there any workable DNA?
VOICE OF NORA RIGGS
We did confirm that the drops do not belong to the victim. The drops are type O positive. This body, we want to run a micro DNA test. Since no one has come forward yet so it's useful when we have a small DNA sample or a need to confirm identity when there are missing parts. Usually when we find only the severed part we can compare the body's DNA sample with the mother of the suspected victim. Between a mother and daughter there is a unique genetic match.
VOICE OF DUGAN
So if the sample from the unconfirmed victim does match the mother's DNA we can conclude that the unconfirmed victim or part is or from the missing daughter.
VOICE OF NORA RIGGS
In a nutshell, that is correct. If the foot is found we will be in a position to confirm. If someone does identify the body before that we may not need to go that route
89
54A INT - RESTRAURANT - NIGHT (day 9) 54A
DUGAN
Did you run prints on the sap the sheriff arrested in the desert case?
VOICE OF NORA RIGGS
Prints did not match Sheriff's Don's man or any other print in the three cases. I do have a time in the dumpster case based upon the maggots in the cavities, it appears at least two to five, maybe six hours before it was found.
DUGAN peeks over to his wife reviewing the wine list.
DET DUGAN
Are you sure on the time frame because we are getting a negative on machinery noise during a certain period we are looking at.
VOICE OF NORA RIGGS
Consider flies are attracted to dead bodies. They lay eggs within the warmer cavities. After a while the larva sets in, finally the maggots are born. This whole cycle takes two to five hours.
DET DUGAN
With that I better get a good bottle of wine
35C EXT - DETECTIVE CAR - DAWN. (day 10) 35C
DUGAN sit inside an unmarked police car watching the suspected apartment building through binoculars. SHELL reviews the search warrant
DET SHELL
Do we have enough independent probable cause without MARSHALL'S dubious entry?
DET DUGAN
Landlord says the tenant is TOM SUTTON. He was seen with a circular saw recently. He was heard to be using it late at night close to the time of death, and he confirms a bad smell.
90
DET SHELL
You comfortable with the independent source?
DET DUGAN
Hey the judge signed it.
DET SHELL
Some of them barely look at it let alone read it to understand the contents. I just don't want some smart ass defense attorney to pick us apart. I just think that we might be rushing this at the risk that the real killer might be let go on a legal issue or worse...not be captured.
DET DUGAN
You heard forensics. We match SUTTON to the cap and to the wrapping and BINGO.
DET SHELL
Isn't there some pretense we can use to get a comparable print? Where's the motive?
DET DUGAN
Any prosecutor will tell you that we don't need any type of motive
SHELL
Any GOOD prosecutor doesn't go to trial without one. I'm just not sure it's enough
DUGAN
We know SUTTON is constantly complaining of being screwed by baseball. He was a one- time farm hand of the Diamondbacks. We only need to show that under the circumstances that he could be involved. He was assigned by GEORGE and did have dealings with DECKER.
DET SHELL
Your call, Let's do it
DUGAN nods for the signal to be given. SHELL gives the signal.

56B INT - APARTMENT 7C - DARK (day 10) 56B
Officers with drawn weapons, some behind shields, scramble into the dark room. Everyone surprised by the intense darkness stop to regain their senses as they begin scrambling to shine flashlights. Awaken by the ruckus the man in bed leaps out of bed clan only in spandex shorts. He dashes to a window before officers can secure him. The officers' knowledge that fellow officers are outside coupled with the fear of friendly fire they choose not to discharge weapon. In one great swoop the man rips a blanket off of a window and smashes through it. Sunlight bursting through the damaged window and frame allows officers to rush the window to ascertain the whereabouts of the male.
55C EXT - BUILDING/WINDOW 7C - DAWN (day 10) 55C
Officers outside watch and react to the man's smashing and flight through the window as glass scatters everywhere. The subject lands sprawled out onto the ground with the wind knocked out of him. Police with guns at the ready quickly surround the subject. The subject struggles to get up but that attempt fails. An officer places a shotgun to the back of the subject's head.
OFFICER DANN
Go ahead cock sucker. Try it.
The subject lets his body go limp and flat on the ground
OFFICER DANN
Identify yourself NOW
The subject with face flush on the ground and the shotgun still glued against the head speaks
TOM SUTTON
What! What did I do? My name is TOM SUTTON.
56C INT - APARTMENT 7C - DAWN (day 10) 56C
Stunned officers glaze across the apartment. The living room is neat with small bits of clothing scattered. DUGAN is staring at the floor looking at the newspaper clippings with articles of the missing girl in the desert. An officer opens a chest drawer and finds a number of Diamondback caps of different colors and designs. SHELL moves next to DUGAN.
93
SHELL
Starting to look like he might just have something to hide. Look at all the various designs and colors
DUGAN turns to OFFICER MARSHAL who is passing by.
DUGAN
Get CSO in here now Also get forensics down here. I want photos and evidence
MARSHALL turns away and talks in a low volume on police radio. Another officer steps out of the bathroom.
OFFICER THOMPSON
Sir, better come check out the bathroom
DUGAN and SHELL stop what they are doing. They look at each other before moving to the bathroom.
57 INT - APARTMENT BATHROOM - DAWN (day 10) 57
DUGAN and SHELL gingerly enter the bathroom. They cover their nose due to the smell. The tub is moist with a watery reddish/pinkish tint throughout. An officer points with a pen at an object behind the toilet
OFFICER THOMPSON
Over here I found this - a bone perhaps
DUGAN and SHELL bend to get a closer look.
DUGAN
Get forensics over here now!
Crime Scene Officer WEST arrives taking photographs of the scene and items. SHELL opens a vanity door and sees a circular saw with apparent reddish brown stains. She bends down to get a closer look.
SHELL
DAVE, you got to see this... It's a freakin saw and looks like blood
94
DUGAN bends down to get a better look. The saw is dirty, obviously recently used. The blade has markings of reddish stains and on parts of the casing. A closer inspection with the CSO'S magnifying glass reveals flesh and bone fragments stuck to the plastic parts. DUGAN motions for the CSO to take photos. SHELL stands and stops another officer in his tracks
SHELL
Where's forensics? Let's clear away this area so it doesn't get contaminated.
58 EXT - POLICE CAR - DAWN (day 10) 58
TOM SUTTON is handcuffed as he sits in the back seat of the police car.
Officers surround the car with weapons still visible. An officer taps on the partially opened window and speaks
OFFICER DANN
Find mess you got yourself into All the stuff they are finding
SUTTON kicks at the partition screen
OFFICER DANN
You were a ball player huh, I got some advise for you, better get used to playing with different types of balls
TOM SUTTON
Up your! Give me my attorney NOW
47A INT - POLICE STATION - LATE AFTERNOON (day 10) 47A
DUGAN and SHELL sit around looking into thin air as SHELL lets fly a paper airplane. An officer passes DUGAN'S desk and drops a paper on it. He looks at the paper and then reaches for it.
DUGAN
Can we get some good new?
SHELL moves behind DUGAN as they both review the paper
SHELL
Latent on wrapping matches SUTTON.
95
DUGAN and SHELL slap five as MARSHALL stop by to listen in.
DUGAN
The preliminary findings on the cap is Inconclusive, the stains in the bathroom have been confirmed as blood. The contents on the saw confirmed as tissue.
OFFICER MARSHALL
Let's see, a saw, prints, bloodstains, tissue A resisting arrest, the caps, the clippings He better start packing his toothbrush
DUGAN throws a cup at MARSHALL giving him a stern look
OFFICER MARSHALL
WHAT! ...What did I do?
59 INT - LAUNDRY ROOM - EVENING (day 10) 59 A woman, 50ish, is doing laundry in the basement of the building TOM SUTTON lives. Alone she reads a magazine. She notices a distinct foul odor behind a heavy cabinet. The sound of slight movement behind the cabinet is heard. Slowly she approaches the cabinet to investigate while holding a cloth to her nose to impede the smell. SLAM! A cat runs out from under a loose drawer causing the woman to jump and yell out.
WOMEN
AHHH! You scared the crap out of me
Calming down she pulls on a chain to turn on a light near the cabinet. The light bulb gives only a very dim light. The women calls for the cat
WOMEN
Here kitty ...kitty
The woman smiles as she sees the cat seemingly responding to her. The cat comes out backwards partially from behind the cabinet. As the cat moves from the darken area into the dim light. The woman observes that the cat is struggling with something. Suddenly the woman sees an object being dragged. As it becomes partially visible she sees that the object is a foot severed above the ankle. The woman screams and yells out as she briskly leaves the laundry room.
96
WOMEN
HELP me, please someone help me
The cat continues to make its way into an opening dragging the foot until it is dropped upon hearing running sounds. The foot has a Diamondback tattoo on the upper portion of the left ankle.
44B INT - LIVING ROOM (KLINES) - MORNING (day 11) 44B
CHIMES from the doorbell ring out. TOM KLINES answers the door to see DUGAN and SHELL in his doorway.
DUGAN
Sir, I am detectives DUGAN and this is Detective SHELL with Tempe police. We understand that you reported to the sheriff's office that your daughter is missing?
TOM KLINES
Yes, yes she is still missing. Please come in.
KLINES opens the door wide and motions for them to enter. He notices a brown manila envelope being carried by SHELL.
DET DUGAN
Could it be she has just not reported in?
TOM KLINES
Never, we had contact every day until she didn't call three days ago. She didn't report to work. Considering the GEORGE and DECKER deaths we in the Diamondback organization are starting to believe...
TOM KLINES breaks into a sob with the realization that his daughter may have been murdered. He focuses on the envelope.
TOM KLINES
...Is she...? Are those photos? The other day after seeing the sheriff on T.V. I phoned his office to report my missing daughter and to let him know my thoughts. He was here and appeared to be interested but I wondered if he really cared
97
DET DUGAN
I reiterate that we are NOT part of the sheriff's office. We found out that your daughter was missing through a contact at the sheriff's office. We have a theory similar to your belief after looking at the teams' media guide.
TOM KLINES
Thank you, I was beginning to wonder if anyone was listening, if anything was being ...
KLINES pauses as SHELL begins to open the manila envelope.
DET SHELL
Does she have any identifying scars or tattoos?
KLINES nervously looks around and ponders before answering.
TOM KLINES
Yes, she had a old boyfriend, a ball player, design a drawing. She had it made into a custom made tattoo. It was on her left ankle.
DUGAN and SHELL glance at each other.
SHELL
Do you recall the boyfriend's name?
TOM KLINES
NO. But it's on the tip of my tongue
DUGAN
We have a photograph to show to you. We would like for you to try to identify it.
SHELL takes out a single photo and hands it to KLINES who stares at it. His face turns ashen white as he staggers against a wall to brace himself.
TOM KLINES
That's it! That's HER tattoo!
DET DUGAN
Sir, are you sure?
98
TOM KLINES
The tattoo is unique plus the birthmark next... ...I'm sorry, Please continue I'm ready
DUGAN
There is more we need to inform you. We have found a body that we believe is or could be the body of your daughter.
KLINES looks stunned at the detectives but nods
SHELL
We need you to look at some other photos. And to look and perhaps identify the body.
KLINES' eyes begin to redden and swell as a tear drops linger
TOM KLINES
Was... was she raped?
The boyfriend, his name is PHIL BOYER
DET SHELL
None of the cases we believe to be related appear to be sexually motivated.
60 PROSECTOR'S OFFICE - NOON - (day 11) 60
The county prosecutor, ROME, has a disability causing his arm to appear limp. He is at a meeting with supervisors and MARTIN. He is irate at the suppression of the DUNCAN'S confession
PROSECUTOR ROME
Anyone have a clue as to want happened? How in the hell did it fall apart?
PROSECUTOR MARTIN
They ensured me that everything was legit.
PROSECUTOR ROME slams his fist on the table
PROSECUTOR ROME
You should know better. The boneheads in that office left us out to hang. We looked MENTAL. It's a bad reflection on this office and on ME.
99
SUPERVISOR FLAIR
My understanding is they were adamant that there was no coercion. We still have SUTTON as a prime....
ROME makes a grim face and extends his hand to stop talking.
PROSECUTOR ROME
We can't arrest everybody. Cross our tees, dot the I'S
SUPERVISOR FLAIR
We are awaiting forensic results and lab results in regards to SUTTON. A print did "match".
PROSECUTOR ROME
What about the recent U.S. v. PLAZA case? The federal court has said prosecution experts are barred from saying that prints "match".
SUPERVISOR FLAIR
We can still have testimony of how prints were obtained, similarities and differences.
PROSECUTOR ROME
It does look strong on paper But isn't his attorney that sharp fella, ROSIER.
PROSECUTOR MARTIN
Yeah, right again. He is ALWAYS filing motions. He's got my staff running in circles.
PROSECUTOR ROME
What's the basis of his motion to suppress?
PROSECUTOR MARTIN
The defense is asserting that an officer entered the apartment without consent or with a search warrant. That when a legitimate warrant was later obtained it is alleged that some, if not most, of the facts may have included information observed during the initial, let's say dubious, entry.
100
PROSECUTOR ROME
Circle the wagons don't let this one get away. At least AHHOE won't have any photo ops. That guy needs to understand he shouldn't be having news conferences to announce arrests and what charges should or shouldn't be filed. It puts me in a difficult situation.
SUPERVISOR FLAIR
I don't think the public understands that police makes the arrest AND that it's the prosecutor who decides if and what charges to file.
53C INT - FORENSICS LAB - AFTERNOON (day 11) 53C
Criminalist in the crime lab work at various posts. Some examine swabs through microscopes, some weigh items.
CRIMINALIST ONE
This blood on the saw blade is not human
CRIMINALIST TWO picks her head up from her microscope
CRIMINALIST TWO
The sample tissue and the bone fragments appears to be animal.
CRIMINALIST ONE
Is that from the SUTTON matter as well?
CRIMINALIST TWO
Yeah, it's from the saw! I've tested three random pieces and all are the same. Better give DUGAN the news
CRIMINALIST ONE
He is not going to be a happy camper
47C INT - POLICE STATION - AFTERNOON (day 11) 47C
DUGAN is on the phone leaning back in the semi busy station.
DUGAN
You mean I'm not going to be happy?
101
VOICE OF CRIMINALIST
The bone fragments are non circular which means they as well as the blood and tissue tests all indicate non human
DUGAN slams the phone handle in his fist
DUGAN
Do you have anything on the fibers?
VOICE OF CRIMINALIST
W found fibers on the wrappings that match with fibers on two pairs of SUTTON'S pants.
DUGAN
Well at least not everything is falling apart Make sure you get the report to me
DUGAN slams the phone down and looks up. SHELL drops her croissant, cleans her hands with a napkin. She looks at DUGAN who stares at ceiling
SHELL
Let me hear it...What do you have?
DUGAN stands up and stretches his arms out
DUGAN
Well, it appears that forensics examined the saw from the apartment. The results are that the blood and the tissue are not human.
SHELL
What the hell was he cutting? Water buffalo?
DUGAN
We still have prints on the wrappings
SHELL
I hear that he hired ROSIER as his attorney. He always creates problems for the state What about the new fingerprint ruling?
DUGAN shows signs of frustration by puffing his cheeks out before blowing out into space.
102
DUGAN
In the KLINES case SUTTON seems to have an alibi on the saw. If there's an alibi on the fibers then maybe who ever did these killings is toying with us, misleading us, some type of misdirection, a game.
SHELL
Possible but we still don't have a lead other than the writing in DECKER. Still can't rule out GEORGE and a connection between them.
DUGAN stands staring out into space deep in thought
DUGAN
Who is this sick puppy if not SUTTON? If it's not DUNCAN?
49E EXT - APARTMENT PARKING LOT- AFTERNOON (day 11) 49E
(Rear view) A person in dark clothes with a baseball cap over dark hair walks to a black SUV carrying a gym bag. The passenger door is opened and the bag is placed inside and unzipped. Reaching in to put out a cosmetic kit an identification badge with a photograph of a long blonde haired female and a package of hairnets fall out of the bag. ADAM NOLAN jogs into view.
ADAM NOLAN
PHIL, wait! I've been looking for you
BOYER hurriedly puts back the contents that fell out of the bag. The bag is zippered and door shut. PHIL turns to face ADAM.
PHIL BOYER
Sorry dude, spending time with my new girl. She's insecure, the jealous type so I was just getting rid of my past. Remember CARMEN? The blonde, she left her cosmetic stuff at my pad before dumped her. I need to get rid of it.
ADAM NOLAN
You must be in a cleaning mood. You finally cleaned your SUV. It's looks much better without the dust, dirt and grime.
103
PHIL BOYER
Nothing like enjoying nature
ADAM NOLAN
Did you hear about TOM? He was arrested for the murders on the news. But they might reduce bond because of evidence problems
PHIL BOYER takes off his cap displaying his full set of dark hair He runs his hand through it. He puts the cap back on.
PHIL BOYER
Makes you wonder if they got the right person
ADAM stares at PHIL as he starts to run in place.
ADAM NOLAN
Look I better let you go before you get yourself in trouble. By the way, are you feeling okay? The guys were saying you didn't appear to be yourself lately. Later.
ADAM steps away and begins to jog off.
61 INT - SHERIFF'S OFFICE - AFTERNOON (day 11) 61
SHERIFF sits in a large chair smoking a cigar with top aides present.
SHERIFF AHHOE
I just got word that the defense has disclosed documents admitting that the wrapping in the KLINES case did belong to SUTTON.
AIDE
Sir, information is that the fibers match too Those in attendance show their pleasure of this news
SHERIFF AHHOE
Hold on, it belonged to him four weeks before the discovery in the dumpster. His attorney has provided affidavits and charitable receipts that SUTTON donated the wrappings to a charity.
104
The staff quickly changes their demeanor.
DEPUTY BLUE
He probably donated it to cover his tracks
DEPUTY OWENS
Hell on the other hand, it could belong to anybody. From someone buying it at the thrift. From a shelter, to someone at the apartments
DEPUTY BLUE
We got lots of bad press in the desert murder. The federal government might investigate for civil rights violations. After DUNCAN, they want to investigate everything including alleged coerced confessions, green baloney, to alleged jail beatings
SHERIFF AHHOE
Well, this isn't the Hilton. I'm certainly not going to feed them steak and potatoes. They can't cry to mommy all the time. Who cares, the public LOVES me, I tell them what they want to hear on law and order. I get to blame the legislature for any failures. I just smile wide at election time when those old farts, the retired, always vote for me.
DEPUTY OWENS
You can do no wrong for most of them We stay with law and order, dump on the sorry criminals and pity for the victims.
DEPUTY BLUE
Run for governor if they're that dumb
SHERIFF AHHOE
I certainly am not going to educate them. I hope some liberal defense attorney doesn't blab how the constitution applies to everyone, defendants, victims and the voters. It was bad enough JUDGE PATCH talked of legal technicalities, that the constitutional laws is for their own good in the long run.
105
DEPUTY OWENS
No worries, that legal stuff is way over their gray heads, whatever is left of it
AHHOE directs his attention to his deputies.
SHERIFF AHHOE
KLINES blew me off when I tried to get back. him. He said Tempe was on top of it. We need to find out what Tempe is doing in the desert case. See about the murders there and if there is any connection to ball club.
62 EXT - FRONT PORCH (REYNOLDS) AFTERNOON (day 11) 62
RICKEY REYNOLDS sits in his recliner chair reading a New Times article about the murders. He puts down his paper and takes a sip of water.
(Rear view)
Standing nearby is his daughter, HELENE, age 27, tall, and big boned.
She is leaning partially against a column with her shoulder length blonde hair flowing in the slight breeze. She fumbles with the claps on a black medical type bag she is opening.
RICKEY REYNOLDS
You know, it looks like either the police have no clue or there is just too much fighting between agencies to find the killer. The trouble with the sheriff's office is that they investigates more for leaks in his office or ways to get into the media
HELENE
The sheriff's office couldn't find the side of a barn if they were standing in front of it. Don't you have to go see your doctor today?
RICKEY REYNOLDS
I wonder why, she pissed off last time. I think she was believing that I might be the killer of those recent murders.
HELENE
She don't know crap. But I do know you're still hurting from the suicide.
106
REYNOLDS tosses his paper aside as he gets agitated and quickly stands.
RICKEY REYNOLDS
I'm going to go but first, I need to finish cutting some things and maybe walk on down to SPARKY'S. Then I'll take the bus.
HELENE
Don't delay the inevitable
RICKEY REYNOLDS
What about you, you have been here two weeks all ready. You need to get back to your acting and be with your friends. My battle is not with you.
(Rear view)
He rushes past HELENE as she puts a hand to her eyes to wipe a tear lingering on her cheek. RICKEY REYNOLDS walks into the house.
HELENE whispers to herself as she lets out a light cry.
HELENE
Daddy, are you going to be all right? What have they done to you?
63 INT - COURT ROOM - MORNING (day 12) 63
TOM SUTTON sits at the defense table watching his attorney, ROSIER, doing a rapid cross-examination on officer MARSHALL
ATTORNEY ROSIER
Officer, when you knocked on the door of 7C did you hear any response from inside that apartment?
OFFICER MARSHALL
No, I didn't hear a response
ATTORNEY ROSIER
You did NOT hear any shuffling within?
OFFICER MARSHALL
No, I did not
107
ATTORNEY ROSIER
You did NOT hear any sounds from any machine, a saw perhaps?
OFFICER MARSHALL
No machine sounds
ROSIER pauses and changes his position. MARSHALL'S eyes follow.
ATTORNEY ROSIER
And you did NOT hear cries of help Or any other sounds consistent with violence within 7C?
OFFICER MARSHALL
No signs of cries or distress
ATTORNEY ROSIER
You did NOT have consent to enter Apartment 7C?
OFFICER MARSHALL
No, the door just opened when I knocked
ATTORNEY ROSIER
You let yourself in?
OFFICER MARSHALL
I thought maybe something might be wrong so I investigated.
ROSIER lets out a slight grin and approaches MARSHALL
ATTORNEY ROSIER
You agree many fine people in this country leave doors unlocked or even partially opened WITHOUT their being present?
OFFICER MARSHALL
Well, I never have personally done any scientific study on that issue so I could only speculate that may be true.
108
ATTORNEY ROSIER
Assume it were true, many of those same fine Americans with unlocked or opened doors could just be there doing innocent activities?
MARSHALL growing increasing nervous looks over to DUGAN
OFFICER MARSHALL
I assume that could be true
ROSIER moves closer to MARSHALL and in an almost whisper speaks
ATTORNEY ROSIER
Did you ASSUME that the reason that the occupant of 7C did not respond was because he was busy INSIDE a 2 X 3 freezer?
A slight murmur including slight giggling from the gallery.
58A INT - POLICE CAR - AFTERNOON (day 12) 58A
DUGAN takes his hands from his face as he sits staring straight ahead as SHELL drives along the streets.
DUGAN
You were right about the search. The judge suppressed everything from inside the apartment. The pants and fibers can't come in. We may not ever know how SUTTON got those fibers on his pants. We still don't know about the wrappings.
SHELL
Haven't heard any gloating from the DON. This is so not like him. Tell me what's wrong?
DUGAN
That can only mean something bad or he will do something where he will step on his dick.
SHELL
Why don't we check out the thrift store for their records, if any, of how and when they received those alleged donations.
109
64 EXT - OUTSIDE MADISON JAIL - TWILIGHT (day 12) 64
TOM SUTTON walks down the stairs of the Madison Street Jail with his attorney and ADAM NOLAN at his side. A media truck pulls up as the three stroll down the street. A female reporter jumps out of a media vehicle. She watches the trio walk just as the doors to the jail lobby open.
Sheriff DON walks out of the jail lobby flaked by deputies. As the Sheriff descends the stairway he is met by the reporter who slips pass deputies.
REPORTER
Your feelings on SUTTON posting bail?
SHERIFF DON
Just another case of liberal judge lowering bail for bad guys . My feelings are for the poor families who have had their daughters taken away. It's a travesty of justice.
REPORTER
Any response to the suppressed evidence in the Tempe murders?
SHERIFF DON stops and smiles
SHERIFF DON
The best of us get slipped up on technicalities. I certainly feel for them. The court has too much power. These guys get a smart lawyer and find some kind of legal technicality. In this case, any first year law student could have got the evidence thrown out
The reporter decides to bluff the sheriff for information.
REPORTER
It's my understanding that Tempe police have scheduled a news conference. I take it you are unaware of its' content?
Sheriff DON smiles to shield his lack of knowledge of a news conference.
REPORTER
Do you have information that you can share with the public?
110
SHERIFF DON lets out a wide grin often reserved for media knowing any response could blow the sails off the news conference at Tempe Lake.
SHERIFF DON
I can only state that it was MY office that did the initial murder investigation out in the desert. That we have worked close with the Tempe police on the Tempe murders. The identities have been confirmed by family.
The reporter knowing that she has the sheriff willing to talk pushes on with the seemingly affable sheriff
REPORTER
I guess Tempe was going to take credit
Not to be outdone or miss a photo op, the sheriff opens up
SHERIFF DON
It was MY office who gathered the identities. I can tell you the that along with the known victims, the latest is CARMEN KLINES. All are related to the Diamondback organization.
The reporter tries to mask her excitement of gathering previously unconfirmed reports as she steps aside appearing nonchalant.
REPORTER
You do a fine job sir
65 INT - ARIZONA MILLS MALL - EVENING (day 12) 65
Mall customers window-shop while others carry packages or push strollers. Crowds linger around the televisions hanging in the center of the mall and at electronic stores. They are affixed to screens awaiting to view a local news exclusive.
LOCAL ANCHOR
"We apologize to have to interrupt the scheduled program. We have exclusive information that all three bodies of recent homicides have been identified. There also appears to be a link with the Diamondbacks organization. Details on the 10 p.m. news"
111
Members of the crowd turn away from the screens. Some hurry along clutching their children heading for the exits. Two customers, college student types, whom appear to have experimented with a substance have curiosity in their glazed eyes as they talk among themselves.
CUSTOMER ONE
I wonder if it's one of the players You know it could be...
CUSTOMER TWO
Dude, it was a hit!
CUSTOMER ONE
Dude, I think you took a hit too much! But it could have been a CONSPIRACY
They begin to giggle between themselves.
CUSTOMER TWO
No way man, maybe it was some pissed off taxpayer like that dude who burned down those fancy homes in the mountain preserves.
CUSTOMER ONE
I can't tell you nothing without you goofing off on what I say
They stop giggling and a look of concern flashes on their faces
CUSTOMER TWO
Dude, I've got the munchies. Let's eat
They walk away from the giant screen in the center of the mall as they can still be seen talking as they hurry off.
66 INT - THERAPIST OFFICE LOBBY - MORNING (day 13) 66
Loud ratting can be heard as RICKEY REYONLDS exits and closes the door to the therapists' office. He appears exasperated and disheveled.
HELENE escorts him to a seat in the lobby.
HELENE
That didn't sound like it went very well
112
RICKEY REYNOLDS
That woman pisses me off. I get this feeling that the doctor doesn't understand me
HELENE
Let me get you something to wipe your Face and comb your hair, you're a mess.
HELENE opens her purse pulling out scissors, a box of tissue. She reaches in and finds a brush. She begins to comb his hair gently.
HELENE
Hopefully soon this will all be over with.
67 INT - THRIFT STORE - MORNING (day 13) 67
A manager of the thrift store guides the detectives through the store aisles. They go to a corner of the store with a small glass enclosed office. The manager opens a four-drawer file cabinet.
MANAGER
Now you say the day you need the early part of this month?
SHELL nods her head in the affirmative. The manager shuffles through files until he finds a file entitled "donation pick up". He pulls out the file and sits at his desk with it. The papers within are listed by dates. He proceeds flipping the documents until finding the day of the 3rd. He grabs a single sheet placing it on the desk
MANAGER
We did a pick up from a TOM SUTTON. Items included a chair, straps, clothes, a cooler, baseball caps, gloves, bats, a purple wrapping of some sort..
DUGAN
Is there any way to know if you have any of those items still in the store?
MANAGER
Not really, we get them, clean them and we display them. Fact is we have a 50% off sale on the 7th of each month.
113
DUGAN views the store's displays through the glassed enclosure.
SHELL
Do you display everything you pick up? What happens to items determined not appropriate for sale?
MANAGER
If it's clothing, towels, rugs, every week we allow the various shelters, homeless, abuse, drugs, to come and browse around the pile and take whatever they want.
DUGAN
What about sporting equipment?
MANAGER
Here we get baseball stuff. That really flies during baseball season. After the World Series if it's Diamondbacks it don't stay long.
SHELL
Well, we appreciate your cooperation. If you think of something let us know
SHELL gives him a card and they ready themselves to leave
MANAGER
Hey, by the way, I'm not sure if you are fans but I have a bat from the pile and it might be a collectible. Maybe even some value, it's an original Diamondback bat.
The detectives stop in their tracks and turn to the manager.
DUGAN
If you have it available could we see it?
The manager gets off his chair and moves to a cabinet reaching behind it. He pulls out a bat wrapped in a towel. He moves back to his desk and sits. The detectives open their eyes wide with surprise
DUGAN
Please stand back
114
The manager looking confused moves back. The towel is gingerly taken aside by DUGAN to expose a black bat. The bat has an imprinted word of DIAMONDBACK on it. DUGAN turns the bat around until seeing a slight indenture and numerous needle like punctures on the bat.
DUGAN
Sir, we will need to take this bat with us.
MANAGER
Is it that valuable?
53D INT - FORENSIC LAB - NOON (day 13) 53D
NORA RIGGS exams the bat under a large magnifying glass. Next to the bat lies a partial sample of a saguaro tree. The criminalist plunks needles from the tree placing them to the punctures on the bat. Needles appear to fit or at least be consistent with punctures.
NORA RIGGS
It would be safe to say that the punctures on this bat are consistent with saguaro tree needles. It would have taken quite an impact to cause such punctures.
NORA RIGGS goes to another cart and brings back a piece of saguaro tree with an indenture on the tree. The bat is placed at the mouth of the indenture of the saguaro tree. The detectives watch as the bat fits within.
NORA RIGGS
I can conclude that this bats' circumference is consistent with and does fit within the indenture of this saguaro tree.
SHELL
It certainty looks consistent with the injuries inflicted on TAMMY not to mention the needles found imbedded on her body.
NORA RIGGS
We need to run tests with luminol under a purple light to detect blood presence, then see if it is human blood, before we can say that this could or is the murder weapon.
115
DUGAN and SHELL walk away as they head for the exit.
DUGAN
I don't know. We don't know if the needles ARE from out tree! We don't know WHO this bat belonged to! Was this the weapon causing death? Who turned it into the thrift store?
68 INT - REYNOLDS RESIDENCE - AFTERNOON (day 13) 68
RICKEY REYNOLDS is stacking several small boxes in the living room next to the front door. Upon hearing a police siren nearby he become fidgety. He shifts a curtain to the slightest position to peak out.
67A INT - THRIFT STORE - AFTERNOON (day 13) 67A
DUGAN and SHELL follow the manager to an office. He casually sits at a desk and opens the drawer. The detectives watch as he pulls out a copy of a wrinkled donation slip. The MANAGER hands SHELL the slip.
MANAGER
I called you when I found this slip
SHELL nods and holds the slip so that she and DUGAN can read it. The donation slip shows items donated, and an address of the donor
DUGAN
It's dated just after the GEORGE case.
SHELL
Look at this, winter gloves; a black bat with an indenture.
They pause when they reach the bottom of the slip. The name of the donor simply lists the initials: P.B.
69 EXT - CAR WASH - AFTERNOON (day 13) 69
A black Pathfinder is lathered with soap all over the vehicle. The burst of soap ceases. The sounds of a coin being inserted into a machine is heard. A long sprinkler starts blasting a strong stream of clear water. The lather thins as the water moves the soap off the SUV until the water stops.
116
45C INT - FORENSIC LAB -MORNING (day 14) 45C
DUGAN and SHELL quickly hurry into the lab room. They are greeted by NORA RIGGS. She escorts them to a microscope.
NORA RIGGS
I decided to review the baseball caps. At first we could not find anything, no hairs, nothing.
SHELL
Assuming that a person is not bald, isn't that unusual not to find hairs?
NORA RIGGS
It could be that the person who wore these caps had something over the natural hair. There is a number of things one can wear. Here within the rim of the black baseball cap, we found purple fibers. More important we found hair. Some of it is human,
SHELL
Did you find a match?
NORA RIGGS
We compared them with SUTTON and DUNCAN but no matches. Other than the victims no other matches.
DUGAN
So why the rush?
NORA RIGGS points to the microscope
NORA RIGGS
We also found a partial cosmetic smudge on the inside of the leather headband. An attempt was made to clean it but this one smudge was missed And we found OTHER dark hair. It was synthetic!
DUGAN and SHELL take a quick glance at each other.
117

PHIL BOYER scurries around his girlfriend's residence. SASHA watches him dart room to room as he appears to be searching for something.
SASHA
What are you looking for now? Where are you going this time?
PHIL ignores her as he hurries into another room. She flips her arm up in frustration and yells out
SASHA
You're not the only fish in the ocean! Remember, you're not a ball player anymore!
PHIL stops in his tracks and glares at her. His eyes are intense as he takes three steps towards her. Turning extremely slow he continues his venture.
SASHA
Just make sure you don't dirty the SUV like you did last week
58C EXT -POLICE CAR - AFTERNOON (day 14) 58C
SHELL drives with DUGAN in their unmarked police vehicle. They are stopped in traffic on highway 60 due to an accident in a construction zone.
DUGAN
Do we know anything on this P.B. character yet? How about an address?
SHELL
According to utilities records there is no P.B. or anyone name with those initials at that location. They went back five years.
DUGAN
Let's go to the address and see what's up. I'll call the Diamondback's and see if there are or were anyone with P.B. in their system.
DUGAN reaches for the police radio.

SASHA
Stop, will you? Tell me what's wrong. The sun will be going down soon, you don't do good in the twilight. Maybe you should stay and talk.
He ignores her as she stops on the grass. She watches PHIL move to the drivers' door of the Pathfinder. He glances around before entering.
58E EXT - POLICE CAR - LATE AFTERNOON (day 14) 58E
DUGAN and SHELL are within two miles of their destination.
SHELL
Something not jiving here? What's on your mind?
DUGAN

DUGAN
The water department says that the present occupants of the address is a REYNOLDS. First name being RICKEY.
SHELL
Wasn't there a RICKEY REYNOLDS, a local minor league ball player who hurt his throwing arm. He never got his stuff back and they cut him.
DUGAN
He committed suicide not to long ago Who the heck is living there if he died?
75 EXT - RESIDENCE (REYNOLDS) - TWILIGHT (day 14) 74

You haven't paid attention since Ricky Martin shook his bong bong.
They share a light laughter and smile

The detectives stand on the sidewalk conversing with a neighbor, JACK.
JACK
I've lived two houses down for five years.
SHELL
This is where RICKEY REYNOLDS lived?
JACK
Oh yeah! Done took his life not too long ago. They say he was depressed about getting released from the minors. The boy's father has been staying here a few weeks. I reckon it's to pack the boy's belongings. He does seem to be somewhat annoyed. Like something's eating at him. Last saw him walking towards the bus stop earlier today
DUGAN
Doesn't he have a car that he drives?
122
JACK pauses and thinks for a moment before responding.
JACK
Never did see him drive any.
DUGAN
Any body named P.B. or someone with those initials ever live here?
JACK
Nope, the boy lived alone. He did have a slew of girls visiting or staying a few nights. Not bad for someone supposedly washed up.
DUGAN and SHELL prepare to leave and hand JACK a card.
DUGAN
If you can thing of anything unusual
JACK
Well I was wondering why there were two different vehicles parked here although I never saw him drive.
The detectives freeze in their spots and look over to JACK
JACK
Yeah, a red car, medium size. The other was a black SUV of some sort, foreign.
76 EXT - PETE'S FISH & CHIPS - TWILIGHT (day 14) 76 A black Nissan Pathfinder, with tinted windows, pulls into a driveway off of Apache and into a local eatery called PETE'S FISH & CHIPS. The SUV makes its way to the rear of the building where parking spaces are.
58G EXT - POLICE CAR - TWILIGHT (day 14) 58G
DUGAN secures his radio and turns to SHELL as she drives.
DUGAN
REYNOLDS worked for a utility company. He could get names from the media guides Get access to addresses of the team personnel
123
SHELL points as they pass PETE'S FISH and CHIPS
SHELL
I could use a monster burger but the place is crowded now. Let's come back in a bit.
DUGAN
Did you hear what I said? It's viable theory. I remember a report back then that about the time of the death, someone had been harassing the diamondbacks. Blaming them and baseball in general.
SHELL
Coupled motion with the black foreign SUV, the access to the victims, the bat from his address. Makes you wonder if he's postal.
77 EXT - RESIDENTIAL ROAD - TWILIGHT (day 14) 77 A black Pathfinder, tinted windows, drives slowly down a residential street. Brake lights go on as it stops along parked cars. The Pathfinder maneuvers to park between two vehicles. A dim interior light is turned on displaying bare wrists and hands holding a Diamondback media guide under the light. DUGAN
This is UC222, what you got?
124
DISPATCH
The crime lab wants me to relay that when they used luminol on the bat they found blood. It belongs to TAMMY GEORGE.
The detectives pump their fists realizing they have the murder weapon.
DUGAN
Anything else?
DISPATCH
The cosmetic smudge on the baseball cap found in the dumpster case appears to be high grade facial make-up, professional level. The type used in theater, plays, movies.
DUGAN
Tell Nora thanks, I'll bring her shrimp
DUGAN puts the radio away and looks at SHELL with a puzzled look.
DUGAN
Why would the killer leave a traceable weapon with an address? Could someone be setting someone up to throw us off track?
SHELL
Maybe he thought no one would ever find it. If it's not P.B. then this means that the killer could be anyone. More disturbing, the killer could be changing appearances and make himself to be anybody. We can be right next to the person and not know it
DUGAN
Well things aren't that bad. We only need to find one late model black Nissan Pathfinder. How hard can it be to find one SUV in a desert area that loves outdoors? There's only thousands in the valley alone. Let's go eat and let this sink in.
The detectives nod as they move with the green light.
125

HELENE
I need to get back to production on Medical World. What would it be without me?
HELENE laughs moving her head in a way that her hair flips to the side.
RICKEY REYNOLDS
I will miss the time together. Thanks for helping out with junior's stuff. It wasn't just the Diamondbacks, there were others...
HELENE
Stop! You don't need the aggravation. Besides, look at what's been happening out here. Someone is getting payback.
HELENE blinks her eye and slams the trunk shut.

HELENE
Here are the keys to the Junior's house
REYNOLDS
And here are your house keys. Are you sure you have to go so suddenly?
HELENE
I need to meet with my agent. There's a chance for a sequel in that one movie long ago where I played a delusional and deranged woman dressed up in disguises
REYNOLDS
Those were some gruesome scenes What was that character's name?
HELENE
Don't get so sentimental on me When we get to location I'll call you
127
58J EXT - POLICE CAR -TWILIGHT (day 14) 58J
SHELL directs the police car along the lane towards the pick-up window. as she digs for money. She stops behind vehicles waiting for their food. Her position is now between the order board and the building. There is a gap of approximately twenty feet. She turns to look at DUGAN. He is focused on the license plate on the vehicle in front as he runs the plate for wants. Though the gap the detectives fail to take heed of the plumbers in front of the SUV. As a car leaves SHELL moves up to a point directly parallel to the building of which makes the parking area no longer visible.
SHELL
Finding that SUV is going to be like finding a needle in a haystack. The police radio beeps and DUGAN responds.
DUGAN
This is UC222, How can we serve you?
DISPATCH
Command wanted me to alert you that there is a report of a black Nissan Pathfinder, license unknown, that has been parked in a residential area for some time. Reports indicate that a person wearing dark clothing and a baseball cap was seen exiting that vehicle.

128
HELENE walks to the Nissan door and turns to her father
HELENE
Dad, did you forget something?
REYNOLDS looks at her quizzically and pats down his pockets. He reaches into his pants pocket and pulls out a key. He strolls to her and hands her the key
REYNOLDS
I guess you'll need the key to your SUV
58K INT - POLICE CAR - TWILIGHT (day 14) 58K

SHELL turns right onto Apache.
129
SHELL
I WAS going to the way we came until that red car blocked me. It was going so slow I thought I could get back this way faster
DUGAN
The food is going to get cold by the time we get back to the station. Should we go around and eat at the tables out back?
SHELL
Nah, traffic is usually not this heavy. Besides we're not missing anything. Are we?
